Thanks to a unilateral decision made by a Democrat governor, her killer is being spared.

In this case, the instrument of Ms Larsen's death, is an illegal immigrant.
The perpetrator is the State of California. Accomplices are those who refused ICE requests, and those who voted for Sanctuary Statehood.

This is deja vu all over again. In 2007 a similar murder occurred in Milpitas. In that case it was a Chinese victim and a Filipino perpetrator. In both cases drug use was involved. I knew the Milpitas victim. When I heard of this case it brought back all kinds of sad feelings. It was happening again, even though I didn't know Bambi Larson. I hope her family gets justice, as well as any closure they are able to find.

SJ Police Chief Eddie Garcia was interviewed by NBC over the weekend, and had choice words for the sanctuary policies of Santa Clara County. His position is that he is responsible for the safety of the citizens of San Jose, and sanctuary laws get in the way, the heck with them. Finally, someone gets it.

Garcia has a badge, gun and has sworn an oath to protect and serve yet won't cooperate with other law enforcement agencies. As a direct result there are dead Americans.
If he is not arrested, he should be fired. And if not fired then his salary should be revoked.

To me, the mark of a true professional is someone who can admit they made a mistake and then correct it. Hopefully, Chief Garcia is such a man. I would hope that Mr. Newsom is as well, but his actions thus far say no. As far as Rep. Zoe Lofgren is concerned, forget it.

Think AB 109, Prop 47. When san jose closed up the Jungle 4 years ago homeless/illegals, etc., spread out and established bases in the neighborhood where this occurred. they played cat and mouse, moving from river bed to highway underpass, stalking the neighborhood, stealing mail/parcels/bicycles, home/auto burglaries abound. You can even see the hierarchy at work in & around the local stores in the area. These loiterers fit Jerry Jeff Walker's version of " Desperado's Waiting for a Train " to a " T ".

This guy should have been turned over to Ice along with a bunch of others. This should have been voted on by the people of the state. Now our death penalty that is as alreDy voted on is being put on hold. This beautiful woman would still be alive if this dirt bag was deported many crimes ago.

The Sanctuary Laws were legislated as a response to the 2017 changes in ICE policies ; which targeted a specific segment of the population; specifically the ICE Detainer and the ICE Warrant. The ICE Warrant does not require a judge’s signature as a regular warrant does, nor does it require a probable cause for such a warrant, It is signed by an ICE official. It is not backed up by any laws.
The ICE Detainer is a request to county jails to hold someone beyond the legal 48 hrs, for up to an additional 48 hrs, before filing charges. The 48-Hour Rule comes from the Supreme Court’s ruling in County of Riverside v. McLaughlin. It provides that when a person, whether adult or juvenile, is arrested without a warrant, a probable cause determination must be made without unreasonable delay and cannot occur more than 48 hours after arrest. What this means is that the Court must determine whether there was probable cause for the arrest within 48 hours of the arrest. The time period for the 48 hours starts immediately at the time of the arrest.

The ICE Detainer does not require probable cause nor is it signed by a judge.

You say:

"A detainer requests that a LEA (the cops) notify ICE as early as practicable – ideally at least 48 hours – before a removable alien is released from criminal custody and then briefly maintain custody of the alien for up to 48 hours to allow DHS to assume custody for removal purposes..."

ICE is requesting that before releasing a criminal back into the population that the state notifies ICE they are going to do so. Then to hold that person for (and I'm quoting them above) "for up to 48 hours." They say up to 48 hours in order to be within the time period for probable cause review by a judge. All Americans can be held on perceived probable cause for up to 48 hours. Illegal aliens do not have more rights than Americans.

Lets tie this situation together so that it is clear to all readers. Carranza has prior convictions for kidnapping, drug possession, battery on a police officer, trespassing and burglary. Each time he was in jail the state could have notified ICE before he was released. For example: he is jail on the kidnapping conviction and is going to be released in, lets say, 2 weeks. Notify ICE before that release. Then hold him briefly for up to 48 hours (again, the legal 48 limit). If ICE was notified ahead of time the amount of time needed to hold him may be literally 30 seconds, the time it takes to physically hand him off to ICE.

You try to imply that this is the law and is just the way it is. We, the people, create the laws. California just passed SB54 which prevents local law enforcement from cooperating with ICE nor a single dime to be spent on enforcement.

Both the leaders of California and you exhibit the same mentality and this mentality explains the issue facing Americans even more than this article does.

Why, when our fellow American neighbors are being murdered would a person's mind turn to ways to defend the situation or ways to create laws to ensure more Americans are murdered? I believe there are only two reasonable explanations:

1) Self destructive mental illness.

2) You allegiance is not to your fellow Americans, but to non-Americans.

Americans are in their right to remove people falling into either bucket from power or influence.

Part of this is our fault. My generation should have done more to protect you from liberal indoctrination. It has left you hating your country and I suspect your fellow Americans. You spend your energy trying to defend the situation leading to murders of your countrymen. It sounds like you are railing against capitalism in other posts.

For my part in not fighting hard enough against liberalism in the schools I'm genuinely and sincerely sorry.

Legalese gobbledygook from a liberal website. Common sense tells most Americans that entering the US illegally is a violation of US law. That is a crime. Throughout most of the world, common sense dictates that those who enter a country illegally should be detained until deportation, not released into the country. Try approaching the shores of Japan on a private boat with out legal permission. Their coast guard will detain you until they deport you. It is this lack of common sense by American liberals that has given us Donald Trump as president. You have only yourselves to thank.
