I'm with you on this "ticking time bomb" scenario insofar that it is an unlikely scenario, only thus far found in the movies.&lt;/p&gt;&lt;p&gt;I'd be concerned about the efficacy of your proposed Notwithstanding Clause because I believe that a President is a politician first and foremost (sadly).  I can imagine that if the options were A) OK torture and leave in 30 days or B) let the bomb go off (using a "doubt the intelligence" excuse) and keep the Presidency, that  many would opt for option B.  Then they could be the war time President they've always aspired to.&lt;/p&gt;&lt;p&gt;Look at Bush/Cheney.  They've been bragging how America has not been attacked since 9/11.  They conveniently forget that it was under their reign that we were attacked, unlike any other attack in US history.  They ignored the ticking time bomb intelligence and possibly to direct us into a war, any war.&lt;/p&gt;&lt;p&gt;I can't imagine a President sacrificing position for principle. This may not be fair as controlling just for this factor is difficult given the mess of other negative economic events.  That isn't to say there aren't good studies suggesting correlation between rising minimum wages and rising unemployment.&lt;/p&gt;&lt;p&gt;That said, minimum wages aren't generally good ideas economically speaking.  I'm sure given all the other crap, this policy isn't helping employment in Oregon.  That graph illustrates a TOUGH jump. Stifling dissent is not only "not good", but undemocratic.  I didn't mean to suggest that protesting in general is anything but democratic.  I am grateful to live in a place where I can protest peacefully without fear of forceful retaliation from my opposition (albeit only recently).&lt;/p&gt;&lt;p&gt;My point is that this protest has NO specific intent.  It's billed as non-partisan, to which I say "puh-lease".  For some, it is a recruiting tool for those on the margins in any capacity - whether they hate BHO for his black/muslim/unamerican history or those struggling to be one of the few voices of reason as our deficit balloons.  Those groups are NOT the same thing.  The more I watch FNC stoke to fires of the more extreme elements of the movement, because they've been on the outside looking in for all of 85 days, the sicker I get.  A few years ago it was unpatriotic to critique the President in their eyes.  Now the times have changes, the mob's opinion shifted.  I think people should protest. But the vitriol, lies, and pot-stirring that is going on is often dishonest for its own ends.  Our Constitution thankfully allows for us to say what we wish.  That does not mean that I have to quietly sit by and accept disinformation and propaganda (from either side).&lt;/p&gt;&lt;p&gt;Finally, let's not pretend the Republicans have offered anything but "no" and of course tax cuts.  Even Douglas Holtz-Eakin thinks that extending Bush-era tax cuts is not a reasonable course of action.&lt;/p&gt;&lt;p&gt;I feel the same way about many misinformed "tea baggers" as I do the misinformed "9-11 Truthers".  Instead of focusing on tangible issues and policy changes, too many (not all) are caught up in the bile of ignorance, racism and an unwillingness to challenge their own orthodoxy.  Something along the lines of he who talks loudest, has the least to say.&lt;/p&gt;&lt;p&gt;P.S.  About my "vote for someone else" comment.: the Boston Tea Party was a protest against taxation sans representation.  We have representation, we voted for it.  Voting IS what you do in a democracy, representative or otherwise.&lt;/p&gt;&lt;p&gt;P.P.S. No matter what the facts says the fringe elements will never mutter a word of approval for their opponents.  (Read: "Yeah I want him to fail!")&lt;/p&gt;&lt;p&gt;Finally, Rove was a Bush operative at the highest levels.   He was not a political appointee but as close to "43" as anyone could be, professionally and personally.  His opinions cannot possibly be construed as objective in any context.  Putting him on is as disingenuous as calling Dick Morris "a former Clinton adviser" every time he is on Faux News.
