I will agree on one point...CNN isn't perfect. ACLU by the way is a very credible group of lawyers who work hard on defending civil liberties...if you have a problem with them it is either because yo udon't know what they do or you are inline with fascism. Just a thought. I am assuming you don't know what they do. True they need to update some of their policy to account for progress on the same matters, maybe concerning use of cameras in public and technology.

It is relevant since hey are about Constitutional law...you must acknowledge that. People on this forum are lay people at best..not lawyers nor press people.

It is safe to say that the verdict is in. No charges pressed on CNN...Free Speech is still safe through the 1st Amendment...and you cannot wear out a RIGHT.

In this country we reference the Constitution as the Chief document concerning freedoms and laws. If a law written does not stand against the Constitution (which is written for the Peoples pleasure) then consider that that law is almost persona non grata.

There are many laws on the books both Federal and Municipal that mean very little when put up against the Constitution. Did you you it is illegal to be on the streets of Chicago if you are ugly until after dark. This is a setters law and not enforced obviously but it brings up a point that many laws make no sense when the context is changed for and for the peoples use.

The 1st Amendment is the 1st for many reasons. It allows for people to disagree...that may be one reason.

FBI counter terror called it "Felony Stupid" in reference to what the Coast Guard did. Re examine this for a moment. Please don't assume how much research I have done on this matter...go ahead and take a closer look at what professionals are saying.

I have an educated opinion:
1. I am still a journalist with press credentials.

2. I work with ACLU on occasion (they are Lawyers not bloggers)

3. If the federal government does something about it or not you will know more about what has really happened. It is protected speech so I'll put money on it no one will go to jail for this.

4. No one yelled fire in a theater; some one did however yell "shots fired" they are under the ownership of the people and should have answered questions when asked the first time. The Guard caused the panic. CNN just reported what they had.

Reading more about it may give you a better rounded view of what happened.

Common practice...nothing like this will ever go to court because the Constitution still exists...it may be weaker than ever before but the 1st Amendment rules over these other laws. Until they get rid of it completely CNN can report what they want...Escpecialy when they call the Coast Guard to ask what's up and they hang up on them.

The Coast Guard is given power by the people...but that can be taken away by the people...the news media is a public utility for the people... they have a right to know and a right to accurate info. Maybe the Guard should suck it up and admit they screwed them selves...by having bad phone manners...we don't live in a world where the military can get away with anything...yet."

I'm not even a paralegal...I could never give you legal advice. How ever I have been a Stringer (news reporter) I can tell you these tools are how we tell a news story and in every case thus far the 1st Amendment of the Constitution makes this story a "No Worries" for CNN. Next time the Coast Guard will answer questions instead of hanging up. No home training! Some one should call their Mama! LOL

There is something called "pack reporting" it is pretty dangerous but it happens often. One agency gets a story..reports it..then others derive from that first report so that they have the same news. Since budget cuts it is more common. Pretty soon the air is saturated with the same story. FOX uses this. In these instances no one sees the story...they take it from a second hand source. Most do this.

They do not believe that they need stringers because they can always share footage and reports. Broadcast media makes regular use of this through gathering from papers. You know where that is going.

When a law is not enforced it is called setting a Precedent. This wasn't abuse...it was an embarrassment. Everyone is wearing red cheeks over it. Sort of a pie in the face moment.
