Emergencies have been declared in the past but not for things like this, where even Trump says it was not necessary and he only did so because Congress took too long.

I think it also hurts his argument that while he asked for one amount, Congress determined a different amount and he ended up signing that amount into law, essentially accepting their compromise. But since he is fixated on his amount and being the one who gets te credit he made up a reason for declaration.
