What you don't understand is the Marine Mammal protection act.
" No city or States shall attempt to enforce the Marine Mammal protection act unless Authority has been given by the Secretary of Commerce".
The city or States never got that permission from the feds,
Infact, the head of NMFS , Peter Yates told that to the city , but they turned a blind eye.

Well, the city had to get permission from the federal government, the National Marine Fisheries to build a new lifeguard station at the Children's Pool.

The judge only interprets the law, legislation makes the law. And in this case the city and Coastal Commission violated that law.

Yes , around the world, but in La jolla, now there are more the 4 beaches that are over run by seals and sea lions, Children's Pool, south casa beach , Bommer beach and La jolla cove, also all the rocks and bluffs around the cove and gold fish point and the caves.

The seal moved in in 90's because Sea World released seals there, but don't take my word for it , it was testified in court by Sea World in 2005 Valeria Sullivan versus the city of San Diego.

Bryan Pease stated that the ruling doesn't apply to animal sanctuaries.
For your info, Children's Pool is not a
" Animal sanctuary" , it is a trusted beach of the state of California and the city and State CCC has volated 109a of the Marine Mammal protection act protecting seals with out requesting permission from the the Secretary of Commerce of the National Marine Fisheries Service.
And your running for City Attorney!

by your logic wouldn't it be safer for the seals if they were not on this MAN MADE PUBLIC BEACH FOR CHILDREN, were people/tourist that you helped to attracted to see them, could NOT disturb them, like out on seal rock? You and all of the "pro-seal" activist are so selfish that you are domesticating them here just so you all can get up close to watch them...

Chalk up another NO victory for attorney Mr. Stun Gun Bryan Pease the CEO of Seal Watch San Diego/APRL that is suing the city again over the Children's Pool in La Jolla at tax payers expense.
I think your "Grass Roots" are full of weeds.... Time to move onto another state like Hawaii, there they have a real seal that is endanger and you can con the tourist out of there tourist dollars!!!
