In the UPS press release in the NY times dates September 24th, she continually repeats thats mantra.&lt;br&gt;Miss Lynn, these are not your customers! You're taking the easy way out...you have no right to my customer by having UPS deliver your marketing piece to my customer's package.  Even if we aren't competitors, if you want to rent my hotline buyers, then you pay me, not UPS.  UPS has no right to market that mail piece. This is feedback from sources within UPS and if you read the press release from UPS, the last paragraph eludes to this.  What is posted here by Mr. Levey is not the full blown UPS Press Release.  You can see that detail on UPS' website.&lt;/p&gt;&lt;p&gt;Jim, not having a heart attack, thanks for the concern. I think there is more than a Kernel of a point here.  UPS is profiting from directing, direct marketing pieces for paying clients (the list of 12) to be sent with hotline buyers...active mailorder consumers....it isn't brokering....they are placing these paks to customers addresses that we provided via manifesting.  They would not have that address to do this program unless those addresses were tendered to them via a parcel manifest.  The fact that they are delivering that PAK simultaneously with the delivery of that order does not make it acceptable or legal.  Within everyone'e manifest agreement is a confidentiality clause.  If I want to deliver to households for specific demographics, there are ways to do this that are legal....if anyone has used a rural carrier list, you know that those pieces have certain legal requirements for mailing, along with Privacy act issues....so please, don't be so flippant that this is okay and it was bound to happen...&lt;/p&gt;</description><dc:creator xmlns:dc="http://purl.org/dc/elements/1.1/">salexk</dc:creator><pubDate>Tue, 29 Sep 2009 14:51:22 -0000</pubDate></item><item><title>Re: UPS Launches Offers-And-Sampling Program</title><link>http://directmag.com/mail/news/ups-offer-sample-0929/#comment-17778343</link><description>&lt;p&gt;I think it is pretty clear....UPS does not "OWN" the consumer information to provide this program.  As an owner of an etail/catalog company, I do not sell or market my hotline buyers (any shipment being delivered to a consumer makes that address a Hotline buyer).  If I did, I would not let my broker sell it to a competitor.  UPS has no right to sell an advertising program as described here.  I own my customer's information, not UPS.  The manifest agreements that many of us sign does not mean when we tender those packages to the carrier that they have the right to do with those package as they please.  It is for interstate transportation and delivery representation. Our company has the first right to that delivery address....not the carriers to sell or 3rd party market for profit.
