I'm not American, so I'm not sure on the hiring practices and policies. There's probably something in the Texas Occupations Code about what the standards are as far as the hiring and investigation into the age of employees at sexually-themed places, but a quick glance turned up nothing. Actually, after a Google search, it seems to be that these things are regulated municipally... so whatever the municipal code where Corpus Christi is says about checking ID at those places would be the standard that I suppose people need to be held to.&lt;/p&gt;&lt;p&gt;That said, the actual penal code sections (43.25 and 43.26) say "knowledge" is necessary for the nature of the act, but do not specify a level of mens rea required for the age. Which might mean strict liability on that end, if the nature of the act is known. I doubt that the managers of the club did not care her age-- they asked for her ID, after all.&lt;/p&gt;&lt;p&gt;It's also possible that the ID may not have been fake. It could have been stolen and very well have belonged to someone who was of legal age. Then running a background check would have turned up the legal age, instead of nothing.&lt;/p&gt;&lt;p&gt;I guess what I'm saying is that without knowing all the facts at hand, it's not right to jump to conclusions about whether the strip club should be held criminally liable or not. That being said, I do not agree with the club suing the girl. I do not know how just the American tort law system is (what I see on TV and in the news leads me to believe it is not) but in Canada that case would very likely be tossed. Just because he was probably guilty anyway, doesn't mean he should be convicted on a poorly-made case. The whole point of having to prove cases beyond a reasonable doubt is so juries do not (frequently, though I admit it does happen) send innocent people to jail. The principles of justice include a right to a fair trial, and if one is not provided, then the entire justice system is shaken.&lt;/p&gt;&lt;p&gt;Re: commenting, I feel it's fine in an appellate court and you're acting in the interests of your client. The situation I keep referring to above (and what nearly everyone seems to be missing) is that lawyers who are not involved in any way with a case shouldn't make public comments. I also agree you should be able to have conversations with your colleagues or your client. The difference, I find, is when those comments are made without adequate information and are published (like on a blog or in an interview). If I were sitting to dinner with my family, though, and they asked me my opinion about the outcome of a recent trial, I would give it. I would also stipulate that (unless I was trying the case or present in the courtroom for its duration) I do not have all the facts and evidence, and so my opinion could not be a legal one.&lt;/p&gt;&lt;p&gt;Thank you for the book recommendation. To be honest, I have no idea how the people who run Tumblr make money (what with no ads and all of that, which I like), but I'm going to assume for the sake of argument that the more active people are, the more pennies in Tumblr's pocket. So by introducing a system that essentially gives "points" to those who are more active on the site, they are playing on people's inherent competitive nature to get more bling. I don't think it's JUST about tracking activity, or they would just link to "tumblarity". They display the number because they want people to get riled up about this.&lt;/p&gt;&lt;p&gt;And anyone who says they don't care about it is a damn liar. We're all competitive by nature. Tumblr isn't going to enforce something like that because it violates the copyright of the author.
