So many questions that divert and puzzle us would largely evaporate if we just remembered.  Where is federalism in so many discussions?  Somewhat older now, it seems that this matter was just assumed when I was a boy.&lt;/p&gt;&lt;p&gt;With respect to the national government, liberty was primary, constrained only by the charge to defend basic human rights and maintain equality under the law.  As American, this charge was also passed to the states, while at the same time they retained more expansive powers imposing social expectations and requirements that in fact draw limits upon free operation.&lt;/p&gt;&lt;p&gt;Constitutionally, the government of The United States has no jurisdiction with respect to pornography, just as it should have had no jurisdiction with respect to homosexual marriage and now almost innumerable other things.  In fact at this point, The Constitution is only of use when it can be wedged into an argument against something that is opposed, while it is entirely ignored as a constraint against what one supports.&lt;/p&gt;&lt;p&gt;Marriage, again for only one of many things was a matter of state definition and regulation up until the federal judiciary commandeered the matter away,  Two important things to say about this:&lt;/p&gt;&lt;p&gt;First, such commandeering is only successful because a distracted and amused people are psychologically overwhelmed by the certitude of a media that is appears to state a national consensus, though it in fact represents a smaller than 1% of the population to whom the fates have accorded the shining display provided by cameras, microphones and broadcast facilities.  And, that population is socially and constitutionally a relatively shallow and unreflective one at that.&lt;/p&gt;&lt;p&gt;And secondly, the states accordingly have ceded their due constitutional jurisdiction over all of these things.  States with a modicum the fortitude for the deference accorded them by The Constitution, would forward to any agency of the federal government that posed to impose on their business, a polite letter informing of their non-compliance.&lt;/p&gt;&lt;p&gt;I think there are three elements that have emasculated the states and the people of them from asserting their due jurisdiction:  1) media as mentioned,  2)  Academia for the sake of its own realm of sovereignty, itself augmented by media, and as powerful as the first two are, perhaps most importantly 3) the lassitude that tends to accompany extraordinary prosperity back through recorded and Biblical history.  Comfortable and spoiled people incline to lose their spirit and mettle.&lt;/p&gt;&lt;p&gt;The United States has had a remarkable show of productivity, prosperity and charity toward causes both domestic and foreign.  They used to say before wounded sensitivity became a virtue, that the opera isn't over until the fat lady sings. Clinton would continue and even expand President Obama’s lawless executive amnesty. Trump has promised that he would revoke those illegal executive orders.&lt;br&gt;Fifth, national security. Clinton would continue the Obama administration’s willful blindness to radical Islamic terrorism. She would continue importing Middle Eastern refugees whom the FBI cannot vet to make sure they are not terrorists. Trump has promised to stop the deluge of unvetted refugees.&lt;br&gt;Sixth, Internet freedom. Clinton supports Obama’s plan to hand over control of the Internet to an international community of stakeholders, including Russia, China, and Iran. Just this week, Trump came out strongly against that plan, and in support of free speech online.&lt;br&gt;These are six vital issues where the candidates’ positions present a clear choice for the American people.&lt;br&gt;If Clinton wins, we know — with 100% certainty — that she would deliver on her left-wing promises, with devastating results for our country.&lt;br&gt;My conscience tells me I must do whatever I can to stop that.&lt;br&gt;We also have seen, over the past few weeks and months, a Trump campaign focusing more and more on freedom — including emphasizing school choice and the power of economic growth to lift African-Americans and Hispanics to prosperity.&lt;br&gt;Finally, after eight years of a lawless Obama administration, targeting and persecuting those disfavored by the administration, fidelity to the rule of law has never been more important.&lt;br&gt;The Supreme Court will be critical in preserving the rule of law. And, if the next administration fails to honor the Constitution and Bill of Rights, then I hope that Republicans and Democrats will stand united in protecting our fundamental liberties.&lt;br&gt;Our country is in crisis.
