It was great to meet you. :)

I'm glad that you liked the panel. I thought the Twitter Lists demo added a nice side plot. It was fairly clear the crowd was interested, so that was why I decided to go with it. But, after 5 minutes, we got back on topic. And, of course, at Q&A time, we'll answer what people ask and they were curious about Twitter Lists. I was so happy that we were able to cover the panel content 100% as planned AND give people this nice Twitter Lists bonus morsel, if you will. I hope it delivered value overall.

And, who knows, maybe one day I too will have access to Twitter Lists.

Thanks again and I look forward to seeing you at the next stop.

Thanks,

Patrick

Re: Managing Online Forums

My pleasure. :)

Patrick

Re: Managing Online Forums

Thanks so much for reviewing the book, David. I agree with the thoughts provided by Greg and Mark. To me, it seems irresponsible on Google's part. But, I would also say that ideas like this have been tried in the past, as well. Maybe not by Google, but still.

Re: lawsuits. I didn't need to opt into anything to view that link that Jeremiah posted that framed his content. It's not far fetched to see how Google might be sued for page framing. Consider the suits that have been filed and successfully won in the past. If they stick their ads on it? That's just a giant bulls eye. http://smallbusiness.findlaw.com/business-opera...

Patrick

Re: Six Pixels and Mitch’s Big Day

Awesome of you to do, Chris. It's so great and important to praise people. It seems like the posts we write about people that get the most attention are the negative ones and part of me really dislikes that culture, even if it is natural. So, I enjoyed this! Great story. :)

One thing I would say is not to discount the boss. One of the reasons Andrea was as great as she was may have been a boss who encourages her, helps her to improve and keeps her on the ball. We all need someone to give us direction and help us grow. The people that work under the "boss" are a direct reflection on the boss. Some bosses don't care, definitely, but many do. My Dad is a boss, and he does.

Like a boss,

Patrick :)

Re: The Power of New

Hey Jason,

Congrats on striking out on your own. Happy I could add something. I would say I agree with your first update, for the most part - if the publisher had actually uploaded the content. But, they didn't. The rights holder did not make this copy available on Amazon.com, when it is their right to determine how the work is distributed. Because someone made the books available, who had no right to, Amazon.com had no right to sell them and, as such, the consumer had no right to buy them. It would be like, for example, if a random person submitted my book to Amazon.com and started selling it to Kindle users.

If you buy merchandise that, at best, the seller wasn't authorized to sell, even from a reputable retailer, it is not unrealistic to think that you might have to give it back, whether that retailer is physical or digital.

As far as how long consumers put up with it... I think consumers have to be understanding. One could argue that Amazon.com should have done a better job validating this work and maybe that is true, but that solution on the whole does not scale. Amazon.com cannot validate submitted works against popular literature as that list is limitless - Amazon.com cannot validate submitted works against less than popular literature because that list is even longer. Perhaps they could validate submitted works against the top X best selling books of all time, but you have to see where that has it's limits.

The Kindle has provided a great thing in many forms and has made a lot of great strides. But, you also must accept that people will try to take advantage of it for their gain in a way that Amazon.com will be unable to protect. It's similar to an online forums scenario where we can moderate our very best, but posts still make it in there that violate someone's rights, perhaps. Yes there are bad posts on good forums, but does that invalidate forums? Does that make the staff at the site bad?

At any rate, in the linked article, Amazon.com did say that: "We are changing our systems so that in the future we will not remove books from customers' devices in these circumstances." Keep in mind this is no small feat and I will be interested to see if they can actually negotiate that. Someone uploads an unauthorized copy, you buy it, they'll let you keep it and somehow, presumably, get the money to the rights holder, even if they didn't want the book distributed digitally? Wow. I'm wondering how they'll pull that off. Amazon.com's ability to open publishers up a bit like this should be applauded just as much as this misstep - the greatest misstep here may have been in communication.

Just my thoughts.

Thanks,

Patrick

Re: The problem with the Kindle

Just saw this, stmiles85: http://www.informationweek.com/news/personal_te...

In this case, I agree with Amazon.com's course of action. Not necessarily every aspect, because I don't know all of the story of how they communicated, etc. But, buying something illegally doesn't entitle you to it.

Re: The problem with the Kindle

The difference is that Amazon.com gave them their money back. I think it's important to make the distinction between this and theft/swiping, because it isn't the same thing. "Amazon steals" is not a fire I want to stoke because it devalues actual theft.

With all of that said, I don't like it, either. Of course, we have to note here that there is more than just Amazon.com that is a party to this, but the publishers and representative bodies, as well. Amazon.com has done great things with the Kindle, things it doesn't always get credit for, and I hope that they'll be able to negotiate with publishers to protect the integrity of a legitimate sale.

Patrick

Re: Top 10 Customer Experience blogs

Congrats on being asked to participate. The way some people think of advertising is alarming. The sense of entitlement some people have is utterly disturbing. Something has to give or a lot of good programming, online publications and communities or services will continue to disappear.

I always say that, if I like something, I don't think "hey, I want the people behind this to struggle for 60 years and then die, penniless!" If someone creates something cool, I want them to be wealthy. That, more than not, means the service will continue and/or they'll continue creating. My monetary goal in life, in managing my websites, is not to just get by, or to just pay my bills, it's to live independently and, hopefully, grow wealth.

It's like people claiming that 99 cents or $1.29 for an individual song isn't a "reasonable" price. Do you know how many people are behind most of the tracks you hear on the radio? Performing artists or groups, producers, engineers, songwriters, assistants. Not even counting labels, the cost of studio time, marketing, styling, distribution costs, the design of that cover for the single and on and on. It's amazing.

Find a new business model, some people say. How many different models are there? You can sell something (like the music industry does), you can have advertisements (like most web properties do) or you can have a subscription model (like some newspapers and publications have done). And, yet, you'll find people saying that all three of those are old models.

Here's the issue. Don't tell me it's a bad model. Give me a new model. If you have a model that you guarantee will pay all my bills right now, I'm all ears.

Thanks,

Patrick
