Here's Steve Ballmer in November 2004 talking how Linux violates 228 patents. Microsoft employs several hundred lawyers. I suspect that they could probably manage to file a lawsuit in the 2.5 years between then and now if they actually had any evidence, if their claim was actually in any way true.

So you're working for a company which out-and-out lies in order to damage the Open Source software community. Has a history of doing it, and continues to do it today, and will continue to do it tomorrow. Microsoft also funded the long-running SCO patent lawsuit & funding another company's lawsuit where it essentially claimed ownership of Linux and sued IBM baselessly. So Microsoft used a proxy to push a nuisance lawsuit designed to create FUD around Linux.

You need to think of your reputation. Personally, I would never hire an ex-Microsoft employee, just as I would never hire, say, someone who had worked for the KKK. I'm afraid that when you work for a company being fully aware of their proclivities, you have to take some ownership for their actions. I hope they're paying you well.

Re: Ch-ch-ch-ch-changes

Let's try this again: the link to Steve Ballmer saying this exact same thing in 2004 is Ballmer in 2004 .

Unfortunately, the latest reporter from Fortune magazine was too clueless to ask Ballmer, 'Since you made this claim in 2004, you've taken no action to enforce these alleged patents and produced no evidence to back up your claims. Why should we believe you when you make this same claim in 2007?'

Re: Playhouse on Park Plans for an Active Summer

I love this news, short, simple, catchy, and entertaining!

Whats going on in Bishops Corner? Exclusive contracts permeate nearly all industries. If you don't like it, start or invest in a company that makes a better product than the one you crave. It's capitalism and there's absolutely nothing wrong with it.

2. Even if the iPhone 3G or 3GS were available on a non-exclusive basis in the U.S., it would only work on the the slower GPRS/EDGE data network of T-Mobile and a few smaller GSM carriers. It could never work on the Verizon or Sprint networks, since they use CDMA 1X and EV-DO. You're not insisting that Apple spend money developing multiple versions of all of its platforms simultaneously, are you? With that kind of requirement, we'd never have any innovation.

I realize that this is a frustrating situation, but in this country, government intervention in these types of scenarios is simply untenable.

Re: Senate GOP health bill moves forward

Here's the kicker: the Baucus/GOP-neutered bill will receive ZERO GOP votes. This is not the kind of negative publicity a company wants. Besides, it was a dumb business move on CP+B's part. Now that businesses see that they use Crowdspring for their work, why would they bother to pay them? They could bypass having to pay CP+B and go straight to the source and submit their project on Crowdspring. Now it looks like CP+B is losing their big VW account. Why do we think it will be any different this time around with Silverlight?

In the past, Microsoft has actively developed a product up until it takes enough market share to be entrenched. Then they just let it fester and use it as a weapon against other platforms. You argued for dozens of posts back in April that it was a really big deal that you could use (a now closed) vector to get access to a user's keychain:

http://www.matasano.com/log/809/a-little-challe...

Either protecting the keychain is important or it's not. You can't have it both ways. If you want to argue that signing should be used for even more purposes, fine. But you can't argue that this is an "irrelevant" feature unless you want to argue that your entire exercise back in April was just an exercise in idiocy.

As an academic researcher myself, I understand that your default instinct is to be critical wherever possible. But you should at least try to be intellectually consistent in your criticisms.

Re: A Roundup Of Leopard Security Features

Thomas, I think I may have confused you when I mentioned "now closed" vector. That was a reference to the fact that Input Managers are better protected now (a crucial component in your previous hypothetical attack). It wasn't referring to LD_PRELOAD.

Your 9:40 am post states that you agree code signing is helping protect the keychain. Nobody said that it would reduce the probability of an exploit to 0. That would just be stupid.

So my question remains: In April you made a big fuss about gaining access to a user's keychain. Now you say it's not worth protecting. Which is it?

(My personal opinion is that it's worth protecting, but that's not the question.)

Re: A Roundup Of Leopard Security Features

Thomas: Don't be silly - nobody ever said that reducing vulnerabilities was bad. Well, nobody except the straw man that you made up.

I did say that it is impossible to engineer a system with zero probability of exploit. This is just trivially true - if you believe you can reduce the probability of exploitation to 0, you reject the fundamental laws of mathematics and the universe in which we live. But I'm sure we both agree that reducing vulnerabilities, and thus reducing the probability of an exploit, is a good idea.

I wish you would just give a straight answer on the keychain rather than continually dancing around and trying to have it both ways. At this point I don't know if this is supposed to be a security forum or a legal forum. If you don't think Leopard does anything at all to protect the keychain, why did you write, "protecting nothing but keychain was a bad security call on Apple’s part (or a necessary tradeoff with the same effect as a bad call)"? Were you wrong at 9:40 am, or are you wrong now? It's got to be one or the other.

Re: Revolution blahg

Just save yourself the trouble and go with emacs now, once you get used to its power you'll never want to go back.

Re: Bilan de l’opération EEEPC chez SFR : Un flop monumental ? - By Pierre Lecourt - - Blogeee.net

Je suis aussi assez étonné sur ce qui se passe en france (je suis belge). My favorite was a buyer upset that a design didn't look professional enough for their Fortune 500 company. I couldn't help laughing. If they are wanting a professional design, then why aren't they sitting down with a company and working on it with them? This process is shoddy, lacks any real communication and to be honest, looks cheap. I run a company and I can't imagine getting something from there. I might as well use those ugly pre-packaged Microsoft templates. I'd save a bundle. LOL

Re: Spec Work Is Evil / Why I Hate CrowdSpring | Andrew Hyde - Humble Yet Bold

It all comes down to the old saying that you get what you pay for. I think not only are designers being lazy but so are the companies that want the design. To get a true identity that stands the test of time takes a lot of work on both sides. These designers and companies want to go the easy route. So be it. The work they receive looks cheap and they have no one to blame but themselves.

It's not surprising since we have been losing fine craftsmanship in all industries for many years. People want quick, fast and cheap. Just look at our automobiles, new homes, clothing, furniture, etc. There's a reason why everyone wants "retro" because the things being produced now could never live up to the products from the past.

Re: New seat! For instance, when I deploy a Microsoft Server product, the first thing it asks me is if I want to run it using a per processor license where each client needs a license, or do I wnat to run it in per client where each connecting client needs a CAL? WTF? I want to buy a server, turn it on and have the owrld connect to it for one price, the price I paid for the damn software! Has Microsoft considered the impetus behind the rise of opensource? Hmmm could it be the fact that MS licensing has gotten so restrictive, ala the ACTIVATION scheme? Imagine all the servers running unlicensed out there 10 years ago compared to today. I am guessing there are less unlicensed servers today, and you are squeezing nickels out of your loyal customers, but you aint spreading your software the same way as you used to. Microsoft in someways was the original shareware, much to their chagrin, however consider the HUGE profits made in the early days when software wasn't so locked down, make weird sense doesn't it. Microsoft helped create the opensource market, where people like me, well smarter than me are building their own software and hey guess what, it works well enough.

On the other points, I work with opensource vendors, and believe me they make it up on consulting dollars, where with Microsoft products and tools from ISV's I can implement a solution in a few days, I see my opensource vendors struggle sometimes for weeks rewriting code. They also suffer when trying to scale out PHP applications to handle thousands of simultaneous connections, CHOKE! They often don't know why, opensource is supposed to be so good? Microsoft, IBM, Oracle these companies have all been down the paths of customers needs, at the levels that I am talking about. Amazon, Google, their solution seems to mostly be throwing single purpose hardware at their scalability needs, which lately has become cheaper than licensing Micrsofts expensive software to manage capacity. Now I have done it, I have talked myself in to open source. Sorry Robert!

Re: WordPress.com was down for about half an hour

One word "APACHE".

Re: Talk Technorati to me, baby!

Yeah, TMI, Blog Search Porn is too much.

Re: #22: Guy says “this is the coolest thing since the Macintosh”

About as exciting as placing a banner ad engine on your desktop. I don't like the registry, one, becuase even when I "unInstall" something artifacts remain in the registry, I love seeing all the entries for AOL even though I have NEVER installed anything from AOL on my machine. Why doesn't the registry unload these old paths to nowhere? Half of my speed issues come from bad registry paths, why doesn't microsoft make a decent tool to fix the registry? Why should I fork out $25 bucks to a third party to keep Microsoft software working? I hope Vista addresses these issues. I really really hope they do because now that I have Ubuntu running on my VMware Player (took about 20 minutes to install everything) it's a matter of time before the free or cheap desktop becomes reality for millions more people.

Re: Om talks about Apple 2006

He will unveil the MacTel. I simply look at the market. I have had so many vendors using the LAMP methodology on their Servers, that I would be ignorant and a bad business person to ignore it. I started out on the IBM PC-JR, then went to AMIGA, then it was MAC for 10 years at home/PC at work. I will continue to use the Wintel platform at work, at home, my wife constantly bitching about the Slow-as-hell Windows-XP machine, do I want to fork out another $500 for another machine? No. I need to reinstall Windows-XP becuase it has become almost unusable, why does the hard-drive spin forever? Why? What the hell is it doing? Why can't I open my email. Why can't I burn a CD? Why doesn't Microsoft release a new OS? It's hard to explain these issues to my wife. She wants to go online, do some stuff, get her email, that's it. i am not getting the happy shiny feeling from MS, I have been hearing that Windows-Vista may ship in 2007, is this true? Are they waiting for the hardware manufacturers to lower their price points on new faster hardware? Why can't a HUGE corporation like MS get their act together? People will choose to obey it or not, the lawyers will get richer, and everyone will lose in the end. The amount of energy expensed on idiotic protections is out of control. Most people don't care what goes on behind closed doors as long as the rent is paid, and the job is getting done. What people don't like is legislated morality. The software's "search across computers" feature allows users to search for information stored on other PCs and servers. To do this, Google stores an index of files contained on a PC running the software for 30 days, promising that the information is encrypted and accessible to a limited number of Google employees, according to Gartner.

...
Love that part about being stored for 30 days, long enough for the government to subpoeana them? To de-crypt the contents of your hardrive. I can see a whole new class of spyware coming soon. Any hacker worth his salt will be creating their own versions of desktop search, this makes user acceptance so easy. How hard would it be to create your own version of Google Desktop search? You make a lot of valid points. Most important is the one that you start with: the appraisal management companies don’t have a financial stake in the transaction, and that’s a good thing. In fact, the same could – and should – be said for appraisers in general.

The emotional aspect that datadude mentions is a very influential component in any real estate transaction, one that in no small part led to artificially inflated prices bringing the bubble to the point of bursting.

One thing that troubles me about this whole controversy is the way in which all AMCs are being painted with the same broad brush.

There are quite a few large and reputable AMCs that have been in the business for decades and whose business model and assignment criteria haven’t changed one iota since HVCC. They only use certified and/or licensed appraisers and use geographical competency as the primary assignment criteria.

I know several appraisers who work for these companies, and they’re extremely capable, knowledgeable folks who work hard in markets they’re intimately familiar with. Their pay scale hasn’t changed post-HVCC, nor has their commitment to USPAP, nor their professionalism.

Of course, HVCC has created a financial opportunity and incentive for a lot of new AMCs to enter the business, and some of these may indeed be randomly selecting appraisers from a pool and assigning them without enough consideration as to their experience level or geographical competency.

The real lesson here is that lenders shouldn’t be shopping out appraisals to fly-by-night operations, but should instead be steering that important work out to AMCs that have proven themselves reliable over many years.

Like the blog. Keep up the good work.

Re: Thread

Once you reach a certain size you just have to have middle managers. What really matters is their attitude. Avoid promoting people who get a buzz out of telling people what to do - IME the best middle managers are approachable yet quite humble. Go for people who see their job as providing the conditions for others to achieve. And avoid hype about "leadership" - if you set out to consciously lead, u r not doin it right. Leadership happens when you`re doing other things.

Re: My Thoughts on NoSQL

> I don't understand how bigtable has a single point of failure

Really?

I refer you to Google's explanation of the recent App Engine outage: http://groups.google.com/group/google-appengine...

Just because you have failover, doesn't mean it's not a single point of failure. I would strongly disagree that anyone (except Canadian graduates or those with political connections) is able to legally enter the US (to work) without waiting for a very long time, unless they win the Green Card lottery. The legal process takes years, and more money than many potential immigrants can make in their home country. Many choose to come to Canada, wait three years to get citizenship, and then enter the US under NAFTA. It's a cheaper and often shorter process that way.

I'm starting to realize that many Americans don't seem to realize how difficult it is to enter the US legally. I'll be working there legally this summer, but only by exploiting a technicality in the VISA requirements.

Re: Are 'Illegal' Immigrants Illegal?

I believe the US courts have already ruled that social services can not be in any way restricted for legal immigrants. While such restrictions would probably be a great way to win over many anti-immigration-types, I just don't see it happening in America. I believe Canada does have something like this, though.

Re: Good Economics on a Favorite Silly Idea

Muirgeo,

So what is stopping you? Solar panels, wind generators, and the rest are all available right now. Heck, I can remember plenty of articles 30 years ago in Mother Earth News describing how to achieve personal energy independence. I am sure there are a few hardy souls living in the woods right now who are energy independent.

To do it as you describe is still largely possible. All it would take is a significant part of your income and maybe all of your savings and a large loan. The movement could use a few early adopters to get things rolling. So what is stopping you?

Once you add it all up, perhaps the idea of opportunity cost would start to sink in. I suspect you are looking for someone else to do the heavy lifting.

Re: Good Economics on a Favorite Silly Idea

Muirgeo,

"Did you watch the recent battle over the energy bill which would have ended the current $15 billion dollar subsidies to the oil industry just to continue present subsidies for solar and other renewables?"

I am no expert on the oil industry but I wonder what the net subsidies are after taxes. You are preaching to the choir here if you are arguing against government subsidies, but of course you are not. You just want the subsidy going to you and your pet interests.

"Can you imagine the price of oil if they had to get it on their own from THEIR own private property or from governments like Iraq or Iran that wanted to nationalize their oil industries."

You read this blog regularly and you still think that the price of oil is dependent on the cost to extract it?

"So please don't pretend that I'm anymore a socialist then those that run the oil companies."

So you admit you are a socialist but no more so than some others. Why so reluctant to embrace that label? Recognition of the problem is the first step to a cure.

Re: Feedburner en pocos pasos

Por lo tanto no funcionará con servidores IIS?

Re: Farmville Coins & Farm Cash, vad är skillnaden?

Nice blog.
