If the literature was written in such a way to deliberately or effectively cause offense - such as the irrelevent promotion of lap dancing to support crime protection/prevention, purposefully seeking out Jewish or Muslim organizations and requiring them to display irrelevent images of pigs, telling "brown people" to vote a certain way - then no.  If, however, it was an accepted and benign cultural image (such a soppy doggie is alert and prevents crime), then the taken offence is the offendee's problem. All of a sudden these people want you and I to start paying attention to the Ten Commandments--well, at least the one that says, "Thou shalt not steal".  Of course, these people do not mention the fact that they overprice CD's to beat the band-no pun intended. I would urge anyone downloading music--even if you think it's legal--STOP.  Two wrongs do not make a right.  But take one more step.  DO NOT GO INTO THE RECORD STORES.  Before too much time has passed, the music industry is going to have to come up with another explanation of its sagging sales, especially if 50% of people stop downloading and the sales in the stores are still dropping. CMSs (and trust me, I've worked on a few in my time!) tend to fall down on the client side, rather than the server side. Rarely does a "Rich text editor" based on MSHTML provide sensible compliant xhtml markup (normally relying on you passing the content through a second parser). And the idea of using "AJAX", or remote scripting as those who are not tainted by buzzwords like to call it, to deliver the content on the client is a little silly. Would you expect every user that came to a site using the CMS to have JS enabled? Let alone that, what if they were not using the main browser (!IE !Moz/FF) what then? Are you just going to feed them some page saying "Sorry we are too elitist to allow you to see this page". But, my understanding is that since the Brooke Group case established the standard, there has not been a single instance of recoupment proven in a court of law in the U.S.  There seem to be other Section 2 violations that are much easier to prove, so why should a plaintiff risk summary judgment by alleging predation?  In Europe, I think they use the price-cost test (or per se standards in the case of a firm with established market power) in lieu of recoupment, so there would be no reason for a plaintiff to go that route (though I think arguments were made in the French Telecom case).&lt;/p&gt;&lt;br&gt;&lt;p&gt;Does the failure to prove in a court of law mean that predation does not exist?  No.  The &amp;quot;beyond a reasonable doubt&amp;quot; standard applicable in a court of law is not applicable as a test of reality.  Just ask O.J. That&amp;#39;s right -- when the trust funds are doing well (receipts minus outlays are positive) -- as they tend to do when the economy is booming, as it was during the Clinton presidency, the government is required by accounting rules to issue &amp;quot;debt&amp;quot; that the government *owes itself*.  It is non-marketable debt, by definition.&lt;/p&gt;&lt;br&gt;&lt;p&gt;The Government Account Series is the primary source of increase in total PDO.  Increasing currency in circulation might also contribute, since that too is counted as Public Debt Outstanding -- but currency is expected to increase in a growing economy to prevent deflation.  &lt;/p&gt;&lt;br&gt;&lt;p&gt;So, what are these trust funds?  Things like the civil service retirement and disability trust fund, DoD Military retirement trust fund, Social Security trust fund, highway trust fund, railroad trust fund, etc.  In total, all of these trust funds took in more in revenue than they spent in outlays, and consequently the Government Account Series Debt went up. I will actually go further towards bipartisanship and give some modest credit to George HW Bush&amp;#39;s 1990 budget for being hawkish(but it was passed with a Democratic Congress, IIRC).&lt;/p&gt;&lt;br&gt;&lt;p&gt;Furthermore, if you look at that time period, the public debt did decline -- the government was retiring debt.  There is no solid evidence that the trust fund &amp;quot;evaporated.&amp;quot;  The only even-somewhat credible argument I&amp;#39;ve found supporting your claim was by Sita Nataraj and John Shoven, but their econometric model was extremely sensitive to specification.  Alicia Munnell has a very balanced discussion of what happened with the trust fund here: &lt;a href="http://www.bc.edu/centers/crr/issues/ib_30.pdf" rel="nofollow"&gt;http://www.bc.edu/centers/crr/issues/ib_30.pdf&lt;/a&gt; -- she concludes that spending in the late 1990s did not offset much of the gains in the trust-fund.  But rather, it&amp;#39;s Bush&amp;#39;s 2001 tax cuts for the wealthy that made them evaporate.  &lt;/p&gt;&lt;br&gt;&lt;p&gt;BTW, Clinton caught holy hell from the Republicans and tax hawks when he and Rubin proposed using the trust fund surpluses to pay down debt. Tax revenues increased because baseline economic activity increased.  If you believe that the decrease in taxes *caused* the economic activity, then you&amp;#39;re in the realm of faith alone.  Facts will not support you.  Consider the study by Gene Amromin and colleagues at the Fed that compared the European stock and real estate markets to the U.S. over the same time period and found similar patterns of growth, despite the fact that there was NO similar tax cut in Europe at the time.  If anything, it was monetary policy that contributed to the high (perhaps temporary) growth rates.  The Fed was dumping money into the economy; corporate profits (and profits from flips in the housing market) were raging -- of course receipts were going to increase.   &lt;/p&gt;&lt;br&gt;&lt;p&gt;So, I recognize that since the capital gains tax cuts of 2003, capital gains tax receipts have increased(http://www.cbo.gov/ftpdocs/70xx/doc7047/02-23-CapitalGains.pdf), but by 2005, receipts were only about $50 billion, compared to $119 billion in 2000.  &lt;/p&gt;&lt;br&gt;&lt;p&gt;But note that receipts also increased for the last 8 or so years of the 1990s, when capital gains tax rates were much higher (statutorily, 28% max up to 1997, then 20% max from 1997 to 2003).
