A 600mm IS 4.0 with a 2x extender and/or a 800mm 5.6 IS might be preferable alternatives.

If that is the entire defense -- the video is a parody so we can use any photo we want under fair use -- then the singing group doesn't really have a defense.

On the other hand, if you posted the snapshot to ridicule it (not sure how one would do that) or to illustrate a point about how to adjust white balance or fix chromatic aberation, that would be a different story. You'd have at least an good argument that your use was fair. Which side would win? That would depend on a host of details.

The singing group and the shutterbug might be having a symbiotic relationship going, whether they realize it or not.

Yes, the 40D will be a much better choice for most people, unless they really value being able to get the most out of bright wide-angle lenses and/or specialty lenses (such as a 15mm fish-eye or 24mm tilt-shift).
