Appointments like this generally start with the assumption that the appointing Governor will not give full consideration to anyone outside his/her own party, thus eliminating many candidates who might be the most qualified and everyone is perfectly OK with that. She will be very effective.</description><dc:creator xmlns:dc="http://purl.org/dc/elements/1.1/">Tyke</dc:creator><pubDate>Sat, 03 Jan 2009 02:21:15 -0000</pubDate></item><item><title>Re: Bloomberg Aide Drops Kennedy Push -- Political Wire</title><link>http://politicalwire.com/archives/2008/12/30/bloomberg_aide_drops_kennedy_push.html#comment-4828803</link><description>Good find. &lt;br&gt;&lt;br&gt;A day after unidentified 3rd hand sources say that Sheekey is "pulling back" we have direct quotes from Sheekey himself that clearly ratchet UP his calls for Kennedy to be appointed.&lt;br&gt;&lt;br&gt;New York Assembly Speaker Sheldon Silver also makes statements indicating that he believes Kennedy WILL be appointed, and MSNBC says that "The comments mark a significant change of position for Silver".&lt;br&gt;&lt;br&gt;Sounds like these may be part of a pattern of intentional controlled leaks in an attempt by Patterson to smooth the way and to convince New York voters that a Kennedy appointment would serve NY especially well during the bail out decision making by Obama's administration.&lt;br&gt;&lt;br&gt;Look for a stream of statements from several prominent politicians emphasizing this point. It is Patterson's best strategy to be able to claim he did what is by far "best for NY" if he appoints Kennedy. The groundwork needs to be out there for that to have any traction, so these stories will keep coming out until the actual appointment after Clinton is confirmed. &lt;br&gt;&lt;br&gt;John Kerry chairs the committee that will screen Clinton's confirmation and says hearings will probably be the 2nd week in January. The US Constitutional requirements are set out in the 17th amendment and they also appear to have been met. What exactly is the basis for denying Burris the seat? The duly elected (and not impeached - not have impeachment proceeding even begun) governor appointed a replacement according to the state constitution. I hate to say it, but given the clear wording of the rights and authority of the state AG (he doesn't have a choice in this - even if he makes it go to court) this appointment may well stand.  It has nothing to do with what "should" happen.
