In all other cases, we get juries of 6.

Re: Katie Logic. - I want this image blown up and framed large above...

What does the text say? Which is why the penalties for sexual assault are greater than that for rape.

Obviously, there's a minimum and a maximum sentence for each, to allow for judicial discretion and taking individual circumstances into account.

Had she been charged with sex 1, the report would likely have said "faces up to 80 years".

I don't think ROI has a min. of 10 years. The max is 10.

Here's the statute: http://cga.ct.gov/2007/pub/...

53-21(1) is a class C felony.

Per 53a-35a, http://cga.ct.gov/2007/pub/... the range for a C felony is 1-10.

Re: The End Of The Amero Case

You're actually wrong that the crime Amero was charged of has greater punishment than rape.

The 40-year figure comes from running four 10 year sentences consecutively. The crime, Risk of Injury, carries a 10 year max.

Sexual Assault carries a 20 year max. So four counts of sexual assault, run consecutively, would net you 80 years.

Re: This is what some people were trying to prevent

It brought a tear to my eye.

Re: LWOP for juve not cruel and unusual: CT Supr. But not having seen the brief, I don't know how well the argument was presented. Seems like a throwaway with the heavy reliance on Roper.

I'm just not sure this presented the proper opportunity to hold that LWOP violates 8th Amendment. Further, I do think that hands were tied with sole reliance on Fed Constitution.

Maybe if there was a claim under the State Constitution, more thought would have been given.

Re: How young is old enough? | a public defender

Oh come on. There's no reason for an eight year old to be playing with guns. The kid is still in elementary school. Would you let an eight year old play with sharp knives? Or work on an electrical circuit? Then why are guns different?

I'm all for people teaching their kids about guns, but eight is far too young.

Re: So what’s the equal protection clause for, anyway? | a public defender

Oh c'mon, the distinctions between your examples and this are obvious. There's no definition of "separate roadway" in the statute. Maybe I'll look up some caselaw.

Re: Stopping for school buses, or: yet another needless post | a public defender

It is my understanding of a few towns, but obviously I'm pretty sure that different towns have different rules.

However, if that were the case - that any time a school bus stops there is a risk that children will come running from all directions - then why is there a statute that permits drivers on the opposite side of the road to keep driving? Perhaps the problem isn't the drivers of the cars, but the policies of the schools.

Re: Stopping for school buses, or: yet another needless post | a public defender

Actually, it is my understanding that students are not permitted to cross the street. The bus will come to their side of the street. So, yes, there was no danger that anyone would be crossing the street.

Also, the statute does not require one to stop. That's pretty clear.

So, no, I am not completely wrong. One may say it is common sense to stop, but that's not what I'm talking about.

Re: The AQA thread | a public defender

F*ck if I know.
