In reading your opinion article it appears you have absolutely perfectly defined what conservatives call judicial activism. Assuming everything you say is 100% true than Congress/Legislature should pass the correcting law and the President/Governor should sign it. It is NOT the job of the judiciary to decide their own definition of fairness and make that the law of the land/state.

Believe me you would not want me to be a judge and decide what is "fair" and make that the law. Goodbye graduated income tax. Goodbye affirmative action, etc etc. You only wish activist judges when they rule your way and over rule the legislature.

The identically worded constitutional amendment was enacted in California, Washington, Michigan and Nebraska. Obviously with the national election of President Obama the proposition that Americans are so biased against blacks that the entire race needs special unfair advantages has been disproven. In our competition against the rest of the world we need merit to be the only factor in achievement. Somehow prejudice has not harmed Oprah, Denzel, Shaq, etc. etc, etc.

Openminded92 but it has harmed so many others... i agree that we are past race being a barrier in equality. but financially we are not all up to level. and that well plays a role in many aspects of American life. Affirmative action is both a necessary evil and unncessary good.

For years liberals have pleaded let every vote count. Apparently you believe that until the votes are in opposition to your views and you then plead repress every possible vote. What are you afraid of? Let the people decide.
The standard defense you use is the people are so stupid that they are being manipulated by Connerly. How about the citizens of California, Michigan and Washington understood exactly what they were voting for. They object to racial preferences. Why is that so difficult to understand?

The American system allows for majority rule. Here you are in the minority.

A. Nonimus Neither the US federal government nor any state government allows for majority rule. There are checks in place at both levels to prevent the minority from being gagged, as it were.

However, referendums to amend state constitutions are legal in many of the states, so in this case the majority does "rule," though only if the measure actually makes it to the ballot. Here we see that it did so in only two of five states, though it will almost certainly pass in those two.
