I know it would not help at all. I do understand that Nokia is not obligated to update it's firmware beyond what might be necessary to eliminate any hazardous conditions.
But I feel like it would be a way to raise attention at Nokia that it is a problem. Corporations will file frivolous lawsuits for many reasons, including to suck resources from some other entity. This is mostly the goal I think would be accomplished.
One lawsuit Nokia would probably worry about more is their paltry US warranty service.

I hope Nokia realizes that its US N95 customers are the ones who were willing to purchase a product unsupported by any US carrier. We are the customers you need to impress.
A lot of people ask me about my N95, and it gets a very mixed review. If now the N95 is unsupported, I will gladly share that negative review with anyone who wants to know. I am feeling like I have a $500+ paper weight.
I think if they ignore the N95, we should be looking at a class-action suit. Well, maybe not that extreme, but someone needs to let Nokia know we mean business. They are neither a leader nor a player in the American smartphone market. Nokia needs to behave like the underdog it is here, and go out of its way to earn customers. I doubt releasing an unsupported "Flag-Ship" phone is the way to do this.
