Has she not heard of Creative Commons or at least know that her actions go against the spirit of the creative community? Why fight this fight? Clearly Brian Solis and Thomas Hawk are enlightened in this way becuase they know the realities of the net. If you don't want people to use your work, don't put it online. Lane Heartwell gets to act like big media by using DMCAs and hiring lawyers? What kind of lesson is this to groups like The Copyright Coalition? It shows them that we, in the creative/remixing/web2.0/hippySF community don't practice what we preach. Someone needs to give her a copy of Free Culture or at least make her watch Lessig's TED presentation. I hope Lane does not go to the Creative Commons party tonight or she will be booed on arrival for being an IP bully. She is really no different than RIAA suing children and grandmothers. The net requires the record companies change their business model or else make everyone criminals. And this lesson should remind Lane that getting mad about occasional lack of attribution just becuase she is a pro photographer is a waste of her energy. Go ahead and hide all of your photos on Flickr as private. Remember, obscurity is a greater threat than piracy.

Sure, things could have been handled differently, but I think she made them worse. Lane, do it for the love first, and the money secondarily or be upset all the time. The choice is yours.

Re: Top Ten IT Conversations Shows for 2007

If you bookmark each MP3 in del.icio.us and then burn a feed at Feedburner that points to the del.icio.us rss feed (could be a feed for items tagged: bestofITC08 but from a single user) and then subscribe to that feed in iTunes, it can be done this way.

Re: PayPerPost tests your ethics, & Edelman’s fake blog for Wal-Mart

PayPerPost encourages meritocracy in products and services. It lets companies continue to offer products that are not remarkable enough generate real word of mouth. It lets them be lazy and continue to a "business as usual" business model without having to accept the power that real word of mouth has to offer. Do I think it is a good opportunity for PayPerPost? Yes. Just like spamming e-mail has an ROI. So, PayPerPost encourages bad behavior all around. The blogosphere’s “word of mouth on steroids” was to be the great savior of mediocre products and services.

You indicate that there is no requirement for disclosure per post. Google Ads are different in that you know it is an ad. As a user, you give credibility to Google and the advertiser for their disclosure. This is a subtle different in PayPerPost and Googles business models, but it makes all the difference. Google would be “evil” if they did not. If PayPerPost wanted to adopt Google’s “do no evil” mantra, they would require full disclosure.

Re: Samwers bankrolled Facebook clone, now Twitter clone

This reminds me of another German company that blatantly rips-off designs and ideas in the pro audio industry called Behringer.

Re: Nintendo’s Reggie Fils-Aime addresses OnLive, iPhone competition and used games

"Used books have never taken off. It is great that you removed the "I am now...!" but there is doubt helped you guys gain major traction on 3/18/08. I think the reason they want to cut deals with content makers is because they are used to some sort of revenue stream in the from of subscriptions to TV programming info. If they make you pay, they can be the gatekeeper to the content and give a cut to the content makers. If they let anyone subscribe to any feed and the same user does not care to record regular TV, all they really need to do is make a "dumb box."

I think they may be better of just allowing users to use the TiVo as a dumb box since that is what some users may want. If they don't someone else will come along (Apple iTV) and make that happen. I don't really watch TV, but I do watch video podcasts. If TiVo allows me to download any video podcast I want, I'll buy one today (I may be in the minority).

Re: No Girl? In Naked Conversations, Scolbe and Israel say (not a direct quote) "it does not matter how many subscribers you have, but who subscribes to you." With Twitter, you can add some A-listers and they will add you. Their once illusive attention is now yours. I fear that we are in honeymoon stage of Twitter, and the sweet spot we are in right now might not last tool long. Someone posted about the Dunbar number and Twitter today. If Twitter is the next iteration of blogging, it might have some of the same problems as blogging did, and it will be interesting to see it shakeout.

Re: Tags Are Your New Website

Sounds like Edge Competencies. http://www.bubblegeneration.com/2006/01/edge-co...

Re: Peter says podcasting is inefficient

Why listen to the radio when you can watch TV (both sight and sound is better/more/faster right?)
Why go to the concert when you can just download the song for free?
Why text chat when you can skype?
Why meet in person when you can just meet in Second Life?

Oh, freedom of choice.

Re: Read a news feed, go to jail?

I think in the details of this act, Gonales wants to prosecute only those who try to make a profit by infringing on copyright. People like shows because of their stories, characters, and aesthetics qualities. NOT because of the network, NOT because of their brand of TV, NOT because of their cable, internet, or satellite provider. The best position for these three parties to be in is to capture value along the way. Perhaps if the networks think they should care about their branding, it would be to their advertising customers, not with viewers. Viewers don't care. The same argument can be made for the major music labels. None of them are known for particularly high or low quality, and fans do not care what labels the artists are on until you get to niche, hand crafted labels made out of love for music and fans first, money second.

Remember, Hulu was born out of the same silly entitlement the major networks had when they chose not to play ball with YouTube. Kevin thinks their networks' brand is more important than capturing long term value, investing in good programing, and providing a delivery mechanism viewers want? Invest in the programmings brand. Sure, it needs to be done for every show, but that is the cost of business. Stop reliving past glories and start thinking strategically for the present realities. Who here reads PaidContent because of you ISP's great brand? I didn't think so.

Rafat, thanks for allowing derisive opinions here on PC and the opportunity to agree or disagree in the comments.

Re: Memo To Networks Re Hulu: You're Making A Big Mistake

Do you know what products are made by Proctor and Gamble offhand?
