I'm not arguing with anyone's logic here (as it's all spot-on), but $1 million does seem like a reasonable starting point when you consider the starting points of other similar lawsuits in the past. I used to know someone whose starting point was $10 million per lawsuit, and he usually got what he wanted out of them (which was a lot less than that, obviously).

GREAT article! It's nice to hear from someone who can see through all the hype. I've always found it strange that people with little to no financial literacy or business sense think they can make predictions, ignoring "unimportant" data like revenue and profitability.

Wow, I actually had Big Fix as part of an internet security bundle back when I had Windows XP. Unfortunately, my Vista bundle doesn't include it (yet).

I guess that means the other way to stand out is to have security companies include your product with the existing packages they sell.

I have to disagree with comment #5. Yes, there were lots of Survivor copies, but many other shows still followed the same concept and did really well (like The Apprentice). So You Think You Can Dance is a direct copy of American Idol, yet it's actually a far better show and makes American Idol feel boring by comparison. Twitter is only good because it's popular and because it was the first to gain traction; not because it's well executed.

I've wondered about something like this several times as I compared the buildings in MS Flight Simulator X to those in MS Virtual Earth. My guess is that there will be a way to update the maps in FSX with Virtual Earth and, if that's done soon, I still think it will be a while before Google comes up with a quality flight sim.

IdeaTagger has a really good point. For instance, I think the Zombies application is really stupid. When I see that one of my friends has added it, that doesn't change my opinion. If there was an ad for zombie-related apparel beside their name (based on their choice to display the application), I'm no more likely to click it. I think they should stick to targeting the person viewing the profile.
