GPOA Member, I am glad you have the foresight to right things down. However do you right everything down? You seem to be overly critical of anyone who has a different opinion than yours. Have you ever stopped and asked yourself, " What is in the overall best interest of the citizens of Gilroy and working towards leaving Gilroy a better place than when I found it" ? Every time someone writes something you do not agree with, you blame them to be Rich Alatorre. I am one person, written as one person and have my own set of views that a few others seem to share with me. I am not against you, probably more so than anyone else in this city I have shown my willingness to step up and help the police if I can. And I did when an officer needed some help. Every single employee of this city has a fiduciary responsibility to the citizens of this city. My opinion binding arbitration is not going to change much overall in the grand scheme of things. I also believe that Council members say exactly what they mean at the time they say it. I also believe they get a whole different perspective when they sit down on the dais and have to make decisions that heavily impact peoples lives. As to Derry talking to Woodward, he should not be allowed to talk to his Councilmember? He should not be allowed to have an opinion? I realize his views are also against that which you totally are committed too. Free speech is a part of the Bill Of Rights here is an excerpt of it.

There is a reason our founding fathers placed this freedom first and up front and felt it was the most important right to establish.
GPOA Member you seem to want to defend yourself without stating any reason why your opinion is the only opinion anyone should accept. I would be interested in hearing from you some way, to better the current system, improve our public systems and make Gilroy a better place without asking taxpayers to pay more money. The last election seems to have spoke volumes that the majority of people are fed up with too much taxes. Try avoid being rude, negative, and an overall jackass trying to prove your point.

GPOA_Member Well okay. I didn't think I was being a "jack-ass", but I did accuse you of posting as Future based only on the content, writing style, and the whole incident where you posted as "Parent" and signed Richard Alatorre at the bottom. Regardless though I will apologize for accusing you of posting as "Future" since you say it wasn't you.

Now onto business.

I'm very familiar with the First Amendment, in fact I have spent most of my adult life defending all areas of the Constitution and Bill of Rights as member of the US Armed Forces and a Law Enforcement Officer. I'm not sure how exercising MY First Amendment Rights in a public forum infringes on anyone else from exercising their First Amendment Rights to free assembly / expression. Can you explain that? I post. You post. People read and decide for themselves.

I don't believe my opinion is the only opinion anyone should accept. I try to provide information for people they will never find written in the Dispatch. I believe, this is the opinion part, people can read what I write and easily determine what is a fact and what is my opinion.

As far as making Gilroy a better place without asking taxpayers to pay more money...I've gone over this but I'll put it here again since you asked.

-The only Association that has a contract up for negotiation this year is GPOA.
-It was obvious the economy wasn't doing very well, so over 6 months ago we internally started tossing around the idea of keeping our contract status quo, not asking for a raise or anything other than what we had now. We would do that year by year until everyone got out of this mess.
-The GPOA members (police officers) negotiate their own contract year after year while the City uses a labor attorney that is paid by the hour. The attorney typically comes from San Francisco and his billable hours start when his engine turns over to start his drive down, or at least that is what I have been told by former negotiators on our side. Charles Sakai is not cheap, and since he works by the hour it is the opinion of several of my colleagues who have negotiated with him in the past that he tends to be the sticking point in much of the negotiation process.
-Knowing the City was going to hire this guy we offered them a status quo contract for a year BEFORE negotiations started so they wouldn't have to go to the expense of hiring him.
-Additionally, the City has a 3.5% COLA built into the 5 year budget for each employee. So by us forgoing any salary increase we saved the City 3.5% from the budget they could immediately apply elsewhere plus saved attorney's fees for them - not us since we negotiate our own contract.

The City didn't even respond with a letter telling us "No thanks."

Let me give you a list of things that we have here in Gilroy -
1. 500 court validated criminal street gang members, plus an associates.
2. Over 100 registered sexual offenders.
3. The highest per capita rate of parolees of any City in Santa Clara County.
4. The highest per capita rate of probationers of any City in Santa Clara County.
5. 59 police officers.
6. Two, possibly three, retiring this year. As of the last I heard these positions won't be refilled.
7. Two officers that are going to another agency in the next month or so.
8. AT LEAST two more actively seeking employment with other agencies. (Which means applications submitted, interviews scheduled or completed. In other words in the process.)
9. One other officer with applications into multiple agencies.
10. A City Council that doesn't value Public Safety.

So at this point, if everyone gets out as they have said they would, we will be potentially 8 officers down from where we are right now, regardless of layoffs. This will occur most likely within the next six months.

I don't think that cutting over a third of the City's employees betters the system. I don't believe cutting 10 police officers betters the system. Honestly at this point I believe the damage is done as far as GPD. The actions of the Council have devastated morale and in a very short time turned GPD from a good place to be, into a good place to be from. (Pardon the prepositional ending please.)

The City wants permanent reductions in pay and benefits. We aren't talking 5% or 10%. The City wanted to originally cut $24,000 in pay from each officer (that number might be reduced a little now) AND THEN wanted to start contract negotiations with GPOA. I'm sure they would want additional pay and benefits reductions at that point as well.

The City WOULD NOT offer any assurance that additional layoffs would be averted, regardless of how deep we cut.

The City WOULD NOT even consider a two year salary or benefits reduction and then restoration to what we have now.

The City is NOT interested in balancing the budget. The City wants to break the Unions and believes this is a good time to do it. They got the advice from the League of California Cities.

So what would you do? The City hasn't shown any interest in bargaining in good faith. The City hires an attorney to talk for them, but yet they don't have any money for employees.

How would I make the City better. Fire the Council and start fresh, but that's just my opinion. I hope you didn't find this rude or negative, and I worked diligently throughout not to be a jack-ass.

Ha, ha, not me I have not posted anything in about a month. I am not alone in the some of my feelings, however you are confused. First I want everyone to work as a team to solve the current mess our ( all of ours not just mine ) government is in. I still believe we need more employee’s not less. Anymore layoffs would drag this city and state in to a deeper financial mess. If you the boys in blue think it is just your wives crying you are sadly mistaken. Fire fighters wives and all public employee’s wives, and about 30% to 50% of private industries families are all crying. My daughter had to take a 50% cut in pay to keep her job. She applied at other places however was told out of 30 applications she was the only one that still had a job.
My philosophical difference is that binding arbitration did not get us here and will not get us out. Does not matter which side of the fence your, on for that issue. If anyone out there in all honesty believes that just illuminating binding arbitration will in anyway have a major impact on the current budget crisis, you are so wrong. It might help on one hand, and absolutely cause problems on the other. I am old enough to remember the days of the blue flu and why voters voted it in. If you’re an officer of this city looking for another position at another city, it will not help you. Eventually this crisis will hit every city.
I will state again that I feel top paid city officials should take a pay cut. Those at the bottom of the pay scale should not. The council should dip modestly in to the reserve funds, it is raining dam it and that is what they are for. What I think is not important however, if you are going to accuse people of statements at least put the right words in my mouth.
Thanks for your help officer, but if your, being mad at me helps you cope then I would do anything I can to help an officer in trouble, because I know he would do it for me.

The only flaw is that you leave no elected officials to make a decision thats in the best intrest of the city. Just keep the binding arbitration and change it to the arbitrator is two council people 2 union workers and 3 citizens voted in by the 4 already sitting... Each side can make appointments however it has to be ratified by all four as acceptable.. Something of this nature may actually work in the long run better for everyone and at least you have people who's lives it effects making the decisions. And it only applies if the two parties can not come to terms on a contract.. Maybe be some other idea will work..

I have no political asperations, just intrested in making things better for everyone, unfourtunatly it means you too.. Thanks for the help but in the future I can do without your help... I am very disgusted with the people on here making accusations that are untrue and attacking me of all people for nothing thanks to all of you.. I was looking forward to helping but if this is how you all feel, I have much better things to do with my time.... Thanks

You could have saved face if you would have just stepped up and admitted your mistake. Now you and your cabana boy are soooooo deep into the lie you will never recover, so just stop. You have been caught.

Mark Derry, you have available to you and your staff to ask questions of the Mayor this Saturday morning at 10AM. I wonder why you have not taken the chance, you have been given to ask questioons, and get answers straight from the horses mouth. I talked to several people including Ron Kirkish who took the time to show up and ask questions. Every single person in Gilroy has a chance to ask the Mayor to his face any questions regarding his role in this city and things he has done. He has also invited a city council member to show up and Dion Bracco did and was very happy to answer questions. If people really have a problem with how things are running please show up. Otherwise I will come to the conclusion that no one cares or what is happeing is perfectly ok by everyone elses standards. Try to get all the facts for a change before running off and telling everyone tha sky is falling.. PLEASE and THANK YOU

Jack Ryan if you feel you really have a question.. Please do not hide behind false names.. If you really feel you believe in this tell us your real name. Do not hide be fourth right and come forward tell us how it is. My question for you is why do fire fighters feel they should get all they can from the citizens. Would it not be better to state what you need then lets see if we can come together. I am picking on everyone, including council. But I can call them and have, your anonymous and no way to contact. Stepup and take some heat. We will all get through this and if we work togther we can make GIlroy a better place for everyone.

I do not believe any one group or individual is responsible for the budget troubles facing this city and every other city in this nation. Mr. Derry has it for public safety. He has blasted them for years. Why doesn't Mr. Derry run for Council and make a real difference instead of arm chair quarterbacking it from his printing press.

I wonder why anyone listens to anyone else anymore. I wonder why we even talk to each other. I have been to 2 of the Mayors coffee chats and listened. I have talked to several council memeber personally. I have asked for "input" as to what they believe is this cities situation. I also have spoken to Tom Haglund and realize at no point did he ever merrilly hand out raises to anyone. To make statements as hot off the presses 24 (2 dozen) employees ( I did not check these facts seems no one else ever does) Received raises of 30 to 40% over the last 5 years. Did anyone check the facts on the 5 years before that. Getting the facts seems to be no fun and much more exciting to take a small part of the overall picture to sell newspapers. One fact is people have left the employment of this city for other places and cities that they make more at. So if you do not mind having less quality workers when times get better then cut there pay now. However some people now will leave because they are that good they can get a better paying job elsewhere. My feelings are Craig Gartman had a good idea that maybe some negotiations directly with the unons and see what they want would help. However 4 unions in the same room with each other bringing 4 members is without question going to just be a pissing match over who should get what. It is human nature this will occur and only humans were going to be there. A slightly different approach might work better if one union at a time were to talk to council. One per day.. or Week..

The wheels of this city council are turning slow and to some of us, do not look like they are even moving. Everyone on the council seems afraid to make a decision that will come back to haunt them. (please see other blogs refering to 4/16/07 council meeting). We are now putting an even bigger scruitiny on every decision they make and who can blame them if now they want to try to make sure what they are doing is right. But there is such a mistake that can be far worse and that is making no decisison at all...

Ms. Walker I have the highest respect for in and that you write this column even though you know as you do it people are going to take shots at you, and say in some instances you are a nut case. We are are a nation of some 300 million people and I assure you we are 300 million different points of view.
Here is my point of view free of charge. The council is afraid, of making a bad choice. Unions I have been told (by union members) are expected to get what ever they can for the memebers. someone forgot they are suppose to be responsible to citizens too. Unions have a bad image just ask Frank Bozzo he insists he is not part of the police union, It is an association ask him he will tell you. Websters dictionary disagrees with him.

I believe some pay cuts are in order at city hall (all departments). Some pay cuts will also have to become raises when times are better. say everyone needs to take a cut in pay of a given percentage is wrong. Each person should be given a pay scale based on what we can afford and the value of the job performed. My personal opinin is 3 men on a firetruck in this city is good enough for now and if we can afford a fourth great. Council is not suppose to get all they can from the union, they are suppose to be fiscally responsible to the citizens. So if everyone does have some responsibility to the citizens why cant they sit and talk about what the citizens need for them to get this new budget in place.

We all need to find a way to want what we have, and not have what we want. The latter part is also greed....... IF you feel the city has a signed contract why should any union give up anything. See greed and then decide do I need it too live and support my family, Or I want it to live and support my family?

Local Contractor Indeed... I overheard this back in 2003 by a conversation between coworkers, (City Hall managers, still employed), at the counter in City Hall. Jay Baska said that before he retires he would make it up to his managers for the lack of "raises or merit raises" he has most always denied any management raises while he was building the "pot of gold" over the last decades, He said and promised all City Management back then the, (fear of management with no union, better fear the Jay approach), there would be a day of a raise would come... Jay's promise lead to what today was known as the "Best of Best" raises for managment or most management as a here's the promise he returned.
My understanding from the following this is that he made his promise to the management...
For the Fire Dept.... stand up and be proud because back then Jay's pants were pulled down and you got what you wanted back then.
Today is a new day, may all city employees and those whom didn't have a choice in Januaury reflect and bring a new day of understanding...

I left off the most important part the company you go after is the company you actually worked at.. In my case I did work for American Eagle, most guys did work for Rite Aid and many others.. Thats who you contact as they (Rite Aid Etc) have a liability under the law to verify that contractors they hire pay sub-contractors that perform the work... The law states anyone who hires a contractor to perform work is also liable for payment to the sub-contractor hired by that contractor. Should the contractor fail to pay its sub-contractors the person or persons (company) shall be held liable to pay tthe sub-contractors. It will then be the Person who hired the contractor, to recover from said contractor. This passage is from the Federal Business and professions code. Sorry I should have put this sooner..

I do realize it is more work to have to do this to get paid, but if you want to get paid do it.. Here is how I got paid.. I contacted the local office and asked how to get in touch with accounts payable. I contacted the corporate office and asked how to get paid, I was told hang on for accounts payable. When I talked to accounts payable they said that they had paid for that work already. I explained that I had been the one to actually do the work and had not been paid. She said she would look in to it and of course that is just a blow off.. I called back now armed with the phone number to corporate and asked to be paid. Again I was told they had paid. I told them that if I did not receive payment I would begin legal actions to collect the debt and that I was going to place a lien on the property location the work was performed. Again please let me look in to it further they said. A couple more days go by I wait.. No call back so agian I call, next person I talk to again tells me please do not file a lien and hold off legal action until they look in to it. They call me back and offer half the money ( this indicates you have them) tell them no I would prefer all that I am owed or I will persue action as needed and again throw out there you will file a lien. This gets more attention than anything, as you have the right to file a lien on the property. This does take time a few minutes a day a couple times a week and follow through and you will get paid in full... This does work and persue it.. You might even have to file a lien but do it and you will get your money plus the cost to file the lien.. Thay are banking on people not knowing what to do and being to lazy to collect what they are owed.. Good luck to all... Thanks

crrimson Yeah, the company OneSource/Revacomm pretty much gave me the blow off line "well we haven't been paid yet, as soon as we get our money from joe nerd...." Yeah right like they're going to get money from joe nerd. And I still do need to be paid for my work, so maybe I'll give this a shot. I can guarantee I need the money more than they do right now.
