The ASCAP is crazy! Even I would assume ringtones are in fair use. Most people do not let their phones ring and ring and ring in public and even if they do, most phones won't use a ringtone that's larger than 30 seconds and/or a certain file size so often times the song isn't even distinguishable by people who are around, if they're even paying attention!

Jonathan Bailey There's a lot wrong with their argument in this case. But these types of arguments have been a consistent trend for them sadly.

in 3 Count: Frozen Loot on Plagiarism Today
I'm glad you threw in "if it assumed that every pirated copy is a lost sale." I know people who, for example, own MS Office pirated but if that were unavailable to them they still wouldn't buy it because of the price tag. They'd be using Open Office or something instead. I'd take a gander that were piracy impossible, the money lost that would be made up would be much much less than the $50.2 billion the study is guessing. From what I see around here, most piracy occurs (with the people I know) because the software prices are what they consider to be too high. Thankfully for me, though, I own legally due to academic pricing. :)

Jonathan Bailey For the most part I agree there. I had a friend in high school that was a hugely prolific pirate. This was back in the late 90s but he had a CD wallet filled with dozens of CDs of everything from Office to PhotoShop. In the days before broadband, this was quite a feat.

He had all of this pirated software but not a penny to his name. I don't think he could have purchased any of those apps and probably would have either done without or, as you mentioned, find free alternatives.

I never bought into the "one pirated copy = one lost sale" story. It just doesn't hold up to what I've seen and believe to be true. Do some pirated copies mean loss sales, yes, but one 1 to 1.

No problem, that's what it was sounding like. Thanks for clarifying :)

What does this mean, that Microsoft dismissed the lawsuit? Just that they're blowing it off and not caring about it, or something more technical/legal? :)
Jonathan Bailey Ah, that was poorly worded. Why I shouldn't do these when I first get in. Not dismissed as in the legal term, but dismissed as in blown off or not taken seriously. Nothing legal in that phrase.

Must drink more coffee...

All I can say is, what is Re/Max smoking!? And can I have some??
Jonathan Bailey I'm with you on that one. The only good news is that it wasn't a lawsuit as some had said it was, just a challenge to the rehava trademark filing.

Trademark hinges on confusion in the marketplace. I say, if you're confused by those two logos, it might be time for Rocky to step out of the ring...

in Pizza Hut: Coupon Fail on Inelegant Solutions
We tried to get the same coupon last week and were told it was only valid if you bought a large pizza or something first, then you could get the P'zone for $1. We passed it up, since we'd already ordered 3 medium pizzas on another deal. Husband was disappointed, he wanted the P'zone for his lunch the following day. I'm not sure, though, why it wouldn't give you that option or tell you it wasn't valid unless....
Jonathan Bailey That's interesting. I couldn't even find it though. If it had been with a large pizza we still would have gotten it though because, as your husband so accurately pointed out, a P'zone can become a very nice lunch and that would have saved me money as well. No matter what though, it sucks to have an offer yanked out from under you like that and, for the record, Pizza Hut has NOT contacted me.

Sorry, I missed your reply earlier! Hi again :)

BlogRush is okay I guess. I am not sure I've seen any real benefit from it yet and the widgets are kind of huge and ugly. I'll give it some time, though, before I give up on it! :)

The WHOIS service is certainly abused! Ahem, "services" like aboutus.org, etc., ahem. I hope that a more reasonable solution can be reached, however. For one, maybe the service should only be available at the ICANN website...

in Is “Remember me” still needed? on Colin Devroe
I prefer to be remembered from the start and I get frustrated with sites on which I click "remember me" and they just refuse to. I also use my laptop most of the time and stay logged in to just about everything other than secure sites. When someone else uses my laptop, they know they have to log out of my stuff first or use IE (since I use Firefox). If a site doesn't have a "remember me" I expect that it WILL remember me.

I feel like most people want to be remembered, except on shared computers, of course, and those people know to log out. Even my most computer illiterate of friends understand this. The only people I run in to anymore that worry about cookies are people who are living in 1997 and just don't get it. I got some funny friends. :)

But all in all, at least in the various circles I run in, I feel like "remember me" is unnecessary.

That is really interesting, indeed.
I hope that your wife's company does indeed investigate that situation.

Really makes you think, too, if when you're viewing someone's resume if it's all true or not. I think if I were an employer, I'd be a bit paranoid. Glad I'm not in that position :)

It's not about the link, it's about being really curious as to the right answer, LOL. Here's another guess. #1 does not have the phrase "I declare under the perjury laws of the United States of America that this notification is true and correct." or anything like it... closer? :-D

in Game: Find the Valid DMCA Notice on Plagiarism Today
Interesting! I thought that could have been it because when I first contacted a host a couple of months ago and ended up doing a DMCA, I was told to make sure it was in that format, with correct numbering!

I'll have to keep thinking :)

in Game: Find the Valid DMCA Notice on Plagiarism Today
This is probably a lame-o answer but I'm going to say #2 is correct because it's the only one with the "numbered points."
