You guys are a tough bunch!

I get a couple of calls like that every day. If I am at my desk I will give them the listing agent's phone number, but not the lockbox code. I figure it builds good will with my fellow agents, and it is worth it for that. I make a lot of sales from Buyers who initially think they are calling the listing agent. It's payback for that.

After talking to the buyers who call me, I find out that some are already working with a buyer's agent who may be out of town etc. I spend a minute, I am friendly and helpful, and don't try to swipe their clients. I actually will give them the listing agents phone number. Then I suggest that they if they call the listing agent, they should tell him that they have a buyer's brokerage agreement and would like to see the house if the listing agent will honor that. If the listing agent won't, I tell them to call their buyer's agent and see if he has some one else in his office who will meet them.

Why would I do that? I appreciate loyalty with my clients and I encourage it in others. I believe what goes around, comes around. After all that, every once in awhile the buyer tells me that they aren't happy with their current agent anyway, and if I would be willing to show them the house. (then I say sure!)

Jay Thompson Dan - I do much of the same. But sorry, if I'm on my cell phone away from a PC, I'm just not going to make a lot of effort to help agents that can't help themselves. (and I'd never give out a gate code or a lockbox code).

We also get many calls from buyers already working with agents. I help them where I can and wouldn't ever dream of trying to steal them away.

I'm a big believer in "what goes around comes around". But when faced with utter incompetence, I'm not quite as generous.

Well I always get a buyer's agency agreement signed, about 5 minutes before I write an offer. Not before. I fill in zero's for commission owed if they buy something without me, and when the form changed from where it allowed the parties to cancel with written notice, I started using the non exclusive buyer's agency agreement.

What is all this talk about getting screwed? You drove them around and showed them a few houses, then they use someone else. Big freakin deal. Don't be so petty. If you spend time with people and somehow its not working for them and they don't want you to represent them in the biggest investment of their lives that is their right. Maybe a little introspection is in order.

The crazy thing about the real estate industry is that we think we are above the age old concept of second opinions. It's against the rules to speak to a Seller listed with another agent. If an agent shows you an "open house" you have to let him represent you in your negotiations. Bulls#!+ !

You go to an stock broker for some advice and you decide to buy your stock online or with a different broker. He should sue you?

I think that the banks would rather let the property foreclose. That way they can collect their mortgage insurance payoff . That's cash now. Then they can slash the price, sell at 50 cents on the dollar, and amass huge losses.... if they lose enough then they can get some more bailout money!!!!!....then the executives can split that up, sit back twiddling their thumbs and wait for the bank to actually fail!!!! That's the ticket!!!!

Sounds like a classic Ponzi scheme to me. The con artist gets investors to buy in with the promise of unreal return. The first ones in are paid a huge return with the new investors money, not on real profit generated. The buzz is created and more and more investors buy in. When the pool of money is big enough the scammer disappears with the cash and the "investments" all go into foreclosure.

Jay,
We lost an 18 year old niece about 12 months ago in a similar accident. The pain of losing a young person, just on the threshold of life in a senseless act of stupidity is unbearable. People who say that time heals all wounds don't know what they are talking about. My heart goes out to the brother, he will live with the loss for the rest of his life.

I don't drink (I used to) and when I go to parties it always amazes me how many otherwise good, caring, responsible people drink too much and drive. They never think they are "that" inebriated, they won't be talked out of driving, they are in blind denial about what they are doing.

I think it is pretty amazing that one person has so much power to decide on how that much money gets spent. When they talk about freezing executive bonuses that seems like a joke. "Freezing?" Like the bonuses they were getting last year were okay, just no increases?

In my opinion the warning of impending collapse without the bailout is the second greatest lie the Bush administration perpetrated on the American public and the reason for it was the same...to line the pockets of his corporate buddies.

Giving voters incentives or perks to vote is a federal crime, so the Starbucks, Ben and Jerry, and Krispy Kreme offers are now open to anyone whether or not they voted. They are making it a celebration of voting day. I waited 3 hours to vote early as did about 50% of Georgia voters. Today there are virtually no lines. The turnout is inspiring! I feel like today is a turning point in American politics.

Interesting! I had never thought of the different types of Buyer's agency as possibilities. For years I haven't required it but lately I have thought that maybe exclusive buyer's agency should be a requirement.
