"why should congress not take preemptive action against this behavior?"

beause by and large, legislators don't understand the internet as a medium or as an industry. because burdensome regulations could very well stymie the college kids working in thier basement on the next big thing.

Are you really surprised that the NYT doesn't "get" it?? Good, thoughtful analysis...I agree on all points.

I'm sure your list of supporters know a lot about networks...that doesn't mean that they're not wrong. This isn't a fight between the evil telcos and the "little guy." This a fight between the telcos and the software giants like Microsoft and Google. Let them duke it out in the market. And let the telcos build the networks that benefit all of us.

Congrats on getting FiOS in VA--I've heard nothing but good things. Unfortuneately, we're still waiting here in NJ (Verizon's home state!) to have access to the service.

in Broadband Competition: An Anecdote on The Technology Liberation Front
Does anyone really beleive that competition isn't good for the consumer? It's painful for me to pay my cable bill every month when I know that there are better services out there that are being blocked from my area...

I like your comparison a lot, James...it makes a lot of sense to me. I really think we should allow the market to take care of itself--as it almost always does--and keep Congress' mits where they belong (far away from the internet!)
