After four years of regulation by Matthew Bailes, Executive Director, HCA tenant service has further deteriorated due to his laissez faire management and irresponsible behaviour of service providers given a free rein to regulate themselves who have unlawfully reduced services to tenants and increased their own salaries.

The insolvent Cosmopolitan Housing Group comprising Chester and District Housing Trust (now Sanctuary Housing Association) provides an example.

This tenant now lives in a Sanctuary (formerly Cosmopolitan) flat polluted with carbon monoxide and other noxious gases which has had no gas inspection for four years and no heat or hot water during three of the coldest winters on record.

Julian Ashby has been personally kept apprised of the issues for the entire period and has done nothing to resolve them despite repeated requests and irrefutable evidence.

It does; however, the Charities Commission ignores complaints. They even have the audacity to state on their web complaint form that they may not process it.

Three cyber-terrorist Internet denial-of-service (DoS) attacks occurred within 48 hours of publication by Press Gazette of the comment by Mark Watts and heated argument by NUJ officials, officers, and members. Some of those comments linked to NUJ Club JournoScam web site.

The DoS attacks specifically targeted articles associated with election of a new editor for Journalist magazine and commentary relating to dereliction by the present editor Timothy R Gopsill. The hacker used a self-propagating virus to access the local database as a spam email attachment at about the time that he entered the web site at a remote location to vandalize the same data (23 Oct 09).

Once active on the local computer, the virus installed twenty-one compressed malware files which opened back doors to allow unauthorized users remote access to the compromised computer. Separate protective applications recorded the intrusion. The cost of repairing the damage exceeded £5,500.00 (23 Oct 09). The hacker repeated the web vandalism 24 hours later with a another attack which cost £1,000.00 to repair (24 Oct 09).

The DoS attacks occurred in discrete areas of Internet software yet targeted identical information. That showed a pattern of deliberate intent to vandalize, destroy, or limit access to specific remote information on NUJ Club JournoScam web site also corresponding data at the local level: reminiscent of the vandalism which occurred in 2008.

During the 2008 incidents, Jeremy Dear and Roy M Mincoff aided and abetted Ronald A Johnson (an Internet terrorist). They deliberately neglected to provide promised NUJ assistance to obtain a court restraining order against Internet denial-of-service attacks. John Toner, National Freelance Organiser (informed of the attacks on a daily basis) did not insist that NUJ take action; instead, he deliberately (in a consort with Dear and Mincoff) allowed the vandalism to continue.

During 2008, systems and equipment repair exceeded £500,000.00 which does not include inestimable collateral publishing damage. Metropolitan Police investigated the attacks used for electronic prior restraint and FBI received frequent reports. They will receive reports of the new attacks.

I have never endorsed, and do not intend to start endorsing, candidates. I am more interested in what they can do than what they say. This comment relates to genre and magazine production not content.

Tim Arnold makes a valid observation when he comments on “the appalling quality of material on the [NUJ] website”. As publisher of four of the largest and longest established non-profit web sites on the Internet (which I personally write, design, program, administer, and publish), I can endorse his statement.

Production of the Journalist during the past two decades has been an abysmal failure exacerbated by the switch to online production by Luddites. Apart from the sample, the online Journalist is totally unusable for any type of research by virtue of its programming. The paranoid access restrictions transgress all publishing ethics. To say that it is a “restricted member only” publication is an oxymoron when anyone can access copies at The British Library.

I spent several years introducing DIN (A4) standards into UK publishing and printing during the early 1960s while consultant to The Modular Society (RIBA). That project not only addressed magazine size but upgraded paper production and printing press sizes to incorporate international criteria into UK publishing. Half a century later, NUJ has arbitrarily bastardized the size of Journalist magazine so that it does not fit any standard filing system or computer application which must have considerably increased the production costs.

Apart from the “training and education” site, I agree with Arnold on the condition of NUJ web sites. Technical incompetence and ignorance in production have resulted in an impractical web site deliberately slanted for political expedience. The current editor ignores topics that make the administration uncomfortable. Perhaps more disturbing is the misrepresentation or withholding of official NUJ minutes to slant their use and denial of access to some members.

NUJ does not need a political hack as Editor. It needs someone fully versed in printing, publishing and on online production not a hack journalist who cannot hold a job elsewhere. This campaign for election of a new Editor does not follow those precepts.

Arnold makes a valid point about party membership. I have never belonged to a political party. I believe that party affiliation creates a conflict of interest for investigative reporters. In 1960s, when unions were closed shops with compulsory political levies, I opted-out of that program. Since, I have not paid a political levy and have no intention to affiliate with any particular party.

In future, NUJ should consider a non-member as director of an “NUJ Press” to avoid conflict of interest. Not surprising in an oligarchy, the majority of candidates in this election have emerged from the Tolpuddle Phartyrs section of NUJ.

Ponsford contradicts himself by saying:

"I thought it was fair comment" then "This doesn't mean I agree with it . . . "

He then says: "I don' t think it was 'illegal'." Surely he should make sure and state a legal precedent before he refutes a published statement.

As a participant in the media blackout, I would have thought that he would want to keep a low profile pending complaints against him and Piers Morgan instead of provoking the NUJ member intending to file those complaints.

Gopsill has disingenuously begged the question. He well knows that he has engaged in an email derogation campaign with Jeremy Dear, Nick Serpell, and others for more than a year. They have tried to coerce this union member of more than sixty years standing into submitting to their oligarchic rule.

The media blackout prevents members from knowing about the nine-year prior restraint designed to cover up Dear's repeated pathological lying and alleged criminal activity which allowed the member to spend 111 days in jail with 25 days solitary confinement despite NUJ supporting other members and non-members in similar circumstances. A properly constituted NEC would have impeached him long ago.

Typical of NUJ officers and officials among whom very few take responsibility for any of their actions, “Gatsby” has evaded indictment for agism by disseminating hate speech using a pseudonym as part of the “Dear Smear Campaign”. Jeremy Dear and Timothy R Gopsill willfully used derogatory language to evade a responsibility to investigate complaints exhaustively and without bias.

Although informed of the illegal comment, Dominic Ponsford, Press Gazette neglected to moderate and flag the statement as inappropriate and anonymous although requested to do so. The number and frequency of similar acts leaves no alternative but to request the Met to initiate a criminal investigation of NUJ officials and officers for hate speech and age discrimination against an elderly NUJ member under Employment Equality (Age) Regulations 2006.

A legacy awaits whoever wins the election for Editor, Journalist magazine. It includes both civil and criminal charges also a petition for a public inquiry. Arguably, it could make the successful candidate liable as an accessory after the fact if, as Editor, that person does not immediately mitigate the illegal circumstances that Jeremy Dear and Timothy R Gopsill have either caused or neglected to address.

Both Dear and Gopsill have operated an illegal prior restraint using a media blackout for nine years. A Washington Supreme Court unanimous decision by nine judges (30 Mar 06) cleared the journalist of any wrongdoing; however, Dear and Gopsill ignored that decision to continue their prior restraint and to launch a smear campaign.
