I think that a lot of it stems from the fact that there are so many pirates these companys want to persecute anybody they can get their hands on.  It's similar to shoplifters.  In Massachusetts, as few as 2% of all shoplifters are caught.  However, in addition to the legal penalties, the store may also press a $500 civil suit against the criminal, regardless of what was stolen.
