Murphy: Congress ready for assault-weapons ban</title><link>http://www.washingtontimes.com/news/2013/jan/13/sen-murphy-congress-ready-assault-weapons-ban/#comment-766435612</link><description>&lt;p&gt;There is a question going around the internet that asks: “Can Obama ban guns by executive order?”&lt;/p&gt;&lt;p&gt;The short answer is "YES"--Barack Obama can do anything he wants by executive order--just NOT LEGALLY…unless the Congress acquiesces to such order. However, although the president’s power to issue executive orders is authorized by the Congress and the US Constitution, even the Congress has no power to “change” the US Constitution without going through the amendment process, which has been purposefully set up to be an arduous one, at best. There is a reason that the legislatures of all the states in the union also have a role in amending the Constitution. The Second Amendment is part of the Constitution and cannot simply be changed by Obama or anyone else apart from this process, no matter how much it “seems” to be the “right thing to do”—if I may borrow from Obama and other leftist ideologues.&lt;/p&gt;&lt;p&gt;Normally, a legal executive order can only clarify or modify an existing law--it cannot MAKE new law. By our US Constitution, the MAKING of law is the exclusive purview of the Legislative Branch of our government--the US Congress. Such a divided system as ours, with its three “co-equal” branches, was a deliberate attempt by our Founders to protect against a dictatorship with most (or all) power vested in one branch or the other (the Executive being the most likely). Although the Progressive S.S.C.U.M. controlling our government today (Statists, Socialists, and Communists Unified as Marxists) think they know better, our Founders were wise and visionary—foreseeing that America would not be immune to wannabe dictators and others intent on subjugating the people. Thus, the Bill of Rights—, which continue to be under assault from the left.&lt;/p&gt;&lt;p&gt;Therefore, using executive orders to make law to effectively nullify ANY of the Amendments is clearly unconstitutional and the de facto action of a dictator. The Second Amendment—being the only Amendment that gives teeth to the others, is especially important. Such action (gun ban by fiat) would make Obama no different than the Stalins, Maos, and Hitlers of the past in the early stages of their murderous regimes. It has been said that the ONLY reason for a government to disarm a populace is that those in control of said government ultimately plan to implement policies that the populace will vehemently oppose, and the government fears a backlash. History has shown this to be true—with horrific results. However, those in control of THIS government must understand something: Americans are unlike any peoples of any time in any part of the world. We not only CHERISH freedom—we understand it! We have lived with it for the entirety of our existence as a nation. We will NOT stand idly by to have that freedom wrested from us. This, I promise!&lt;/p&gt;&lt;p&gt;What is most troubling to me, however, is that I am even writing this. Not in my wildest dreams, just a few short years ago. What are we becoming? No!
