The merchant is eally just the intermediary that handles the state's collection of sales tax from the purchaser.  It is always paid by the taxpayer.&lt;/p&gt;&lt;p&gt;California (and all states with a sales tax) require their residents to pay sales tax on taxable items (which differ by location) where tax was not paid, whether by it being online or by it being purchased in Oregon, or a taxable item purchased in a state that doesn't tax it (such as an Ohioan buying clothes in Pennsylvania).
