I disagree with this article. I have used MJNA products and they are great products and I'm verry satisfied. I have also seen how there oil has helped sick children.

Thanks for taking on a controversial topic. I think that anyone willing to read the report will find it quite an eye-opener. Project CBD gave everyone a fair chance to present all sides of the story.

I need help. I have a friend that has a child that has DIPG. I need to make medical grade oil since this seems to be the only thing that works against DIPG. The little girl is going to die in 3 -6 months. I need fast help. I want to give her parents a
medical dose of the oil as soon as possible. What do they have to lose? I can obtain the raw materials but I need to turn it into medical grade oil. This is not a joke. I really need help on this.

So here is some information you all might be interested in hearing.

if you Google KannaWay (this company did not even exist in 2013, it is a subsidiary of MJNA), you can trace this company back to the parent company Medical Marijuana Inc. through a simple Google search. The agreement made with KannaLife states that KannaWay will do all the marketing (MLM aka multi-level marketing scheme) and distribute (internet based) of the product for the company named KannaLife Sciences Inc.

KannaLife signed the very first agreement on July 9th of 2012 giving them the "EXCLUSIVE" rights to patent # 6630507… another thing that is also very interesting in this situation is the fact that a Google search showed actual proof that KannaLife Sciences Inc. did not even exist in the calendar year prior to the signing of the agreement that gave them the exclusive rights to patent number 6630507.

here is a quote from the agreement dated November 10, 2011:

“The prospective exclusive license will be royalty bearing and will comply with the terms and conditions of 35 U.S.C. 209 and 37 CFR part 404.7.”

Notice the words “ROYALTY BEARING” in the statement.

CBD infused Hemp oil is federally legal in all 50 states, PERIOD. Otherwise a good piece by Project CBD.

" On February 6, 2004 the Ninth Circuit Court of Appeals issued a unanimous decision in favor of the HIA in which Judge Betty Fletcher wrote, "[T]hey (DEA) cannot regulate naturally-occurring THC not contained within or derived from marijuana-i.e. non-psychoactive hemp is not included in Schedule I. The DEA has no authority to regulate drugs that are not scheduled, and it has not followed procedures required to schedule a substance. The DEA's definition of "THC" contravenes the unambiguously expressed intent of Congress in the Controlled Substances Act (CSA) and cannot be upheld". On September 28, 2004 the HIA claimed victory after DEA declined to appeal to the Supreme Court of the United States the ruling from the Ninth Circuit Court of Appeals protecting the sale of hemp-containing foods. Industrial hemp remains legal for import and sale in the U.S., but U.S. farmers still are not permitted to grow it."

The DEA has no regulatory power over CBD, THC or any other Cannabinoid contained in NON PSYCHOACTIVE HEMP. The problem was a grey area where "industrial hemp" was not clearly defined and Hemp was not a distinct entity recognized by U.S. laws in regards to the CSA definition of "Marijuana". There was already an accepted international standard on Industrial Hemp qualification, which I believe was also .3% thc. So at this point it was "grey". Industrial hemp had not be designated as separate from "Marijuana" under U.S. law, though international standards existed.

"On February 7, 2014, President Obama signed the Farm Bill of 2014 into law. Section 7606 of the act, Legitimacy of Industrial Hemp Research, defines industrial hemp as distinct and authorizes institutions of higher education or state departments of agriculture in states where hemp is legal to grow hemp for research or agricultural pilot programs."

The Farm Bill created a CLEAR DISTINCTION for the first time that defined industrial Hemp as being SEPERATE FROM MARIJUANA.

" Section 7606 of the Farm Bill defines industrial hemp as "the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis."

"ANY PART OF SUCH PLANT"....... this includes LEAVES AND FLOWERS, contrary to the reporting done by project CBD, and sites like Ladybud that claim that Hemp finishing products must be produced from the STEMS AND SEEDS by law. that is what allows for the current sale of WHOLE PLANT HEMP based nutritional finishing products. There is not ONE THING ILLEGAL ABOUT THEM. PERIOD. That is why Realm of Caring was able to start shipping Charlotte's Web nationally this very month. There are no laws to prevent it.

Cannabidiol is not now, or has it ever been a Scheduled substance, it is only when applied to the term "Marijuana" when ALL cannabinoids become illicit under CSA. Hemp is not Marijuana and has been clearly defined by the Farm Bill, and as such, finishing products made for nutritional supplementation are fully legal. I question much of the legal information presented by the Project CBD report as the precedents that allow for the current sale of WHOLE PLANT, high CBD extracts in the form of Hemp finishing nutritional supplements are easily found above.

You keep hearing "grey area" in the media. The grey area was REMOVED by the Farm bill that defined industrial Hemp as distinct from Marijuana. There is no more grey area. They are distinct under law. There were amendments to the Farm bill that were there EXPLICITLY to define industrial Hemp. the only restrictions left are on GROWING hemp in the U.S., not on producing hemp finishing products.

There are good companies out there making LEGAL Whole Plant High CBD extracts. Do your own research and as with any unregulated supplements, buyer beware, that goes for ginseng or Cannabis oil or Raspberry ketones or whatever supplement is being sold out there. Most of us take that as a given with the supplement industry. Not that FDA regs are much better or result in safer products, ha ha, but at least it is something.

Otherwise......a good piece by Project CBD. I think there is far too much variation between testing facilities and procedures to draw much from the THC level data, but the contaminate data is certainly worrisome for that given sample though more samples would need to undergo similar testing to draw any type of real conclusions as to whether that was batch related or par for the course. If nothing else, it serves as a reminder to folks to do their due diligence as much as possible when it comes to supplements. You can allways pay to have a sample tested if one is concerned about a particular brand or vendor.
