I ethically believe the only reason the Guadalupe and Bexar&lt;br&gt;County District Attorney’s office pursued charges, an indictment,  and a lengthy trial was because he was a&lt;br&gt;member of a minority group that are more likely to accept a plea deal or plea agreement.&lt;br&gt;I hate to say it, but, I’m sure his attorney pressured him and his family to&lt;br&gt;accept such an agreement by the D.A.’s office. I too feel mad for the girl, she&lt;br&gt;will move on with her life with her actions hovering over her the rest of her&lt;br&gt;life because she was not held ethically accountable for her actions by law&lt;br&gt;enforcement and the Guadalupe and Bexar County District Attorney’s Office. The&lt;br&gt;system failed both parties in this case. It is truly a burden to be poor and Hispanic&lt;br&gt;in the state of Texas. I am sure if the alleged suspect was white and the&lt;br&gt;alleged victim was Hispanic, the Guadalupe and Bexar County District Attorney’s&lt;br&gt;Office would not have moved forward with charges when the defendant had solid alibi&lt;br&gt;and evidence proving the alleged suspect could not have committed the crime. In&lt;br&gt;any other case there would not have been an indictment or charges filed. Sad,&lt;br&gt;but, this is just my opinion.  &lt;/p&gt;&lt;p&gt;This is an absolute embarrassment for both the Guadalupe and&lt;br&gt;Bexar County District Attorney’s Office and for law enforcement not able to&lt;br&gt;knowingly recognize if a witness or victim is changing their accounts of the incident&lt;br&gt;that they are showing signs of deception. When questioning a suspect or victim&lt;br&gt;the same policy should apply.&lt;/p&gt;&lt;p&gt;My thoughts and prayers go out to the Castro family. Nelson is considering to deny an individual life and liberty; yet those individuals that have recieved their state license have proven that they have learned from their mistakes. The Big Picture is the Texas senate wants to take away from families such as funds that pays for rent, food, and for jobs that provide health insurance for these individuals children/ family. Sen. Nelson wants to pass a law that  will prevent an individual that has made a mistake earlier in their life, maybe when they were young and foolish, and maybe just a bad chose. If lawmakers do consider senate bill 429 this would open the door for other crimes to be linked to this law; such as DWI offences, the next action the state of Texas would see is not allowing those offenders that have committed a DWI offence would be banned to have a driver license. Amendment 8 - Cruel and Unusual Punishment. Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
