I do think there will be situations in which private land owners get a say on the virtual content over their physical locations. It will depend on the rights they assert (with trademark &amp;amp; unfair competition claims beign the most likely to succeed) and who owns the network on which the content is viewed. Site owners already have the freedom to impose all sorts of terms, and many require arbitration in various circumstances already. I've  written several website policies myself. Whether a like, standing alone., is enough to  make such a term enforceable is open to debate and will depend on the circumstances.  For example, did the user know that or have access to the policy before clicking like? I certainly don't mean to suggest that Klout is the only measure of commercial value, and if someone were misappropriating my likeness, I'd argue that it's worth more than 4-pack of Red Bull.  (I'd go for at least a year's supply.)  My point is more that services like Klout offer a new means of putting objective measurement on goodwill for individuals, in a more directly commercial way than was previously available.
