In a single action semi-auto, hammer down is extremely dangerous with a round in the chamber. Double action semi-autos are safe with the hammer down on a loaded chamber. I carry my P85 hammer down because it was designed to be carried that way. When I carried the issue 1911, it was cocked-and-locked.

When you typed "The 302 report may not be released to the public because it may be filed under seal"
did you mean "MAY" as in "having permission" or, did you mean "MIGHT" as in "possibility?"
As written, there is confusion in the offing, as the two different terms change that line considerably.

Police arrest or not based on ACTIONS. Prosecutors then decide if charges are brought based on EVIDENCE presented by the police. The police are not allowed to bring charges. Only the prosecutors can do that. If the police do not DISCUSS the situation with the prosecutor, they are not following the law and the prosecutor cannot bring charges.

.S. Code › Title 10 › Subtitle A › Part I › Chapter 13 › § 311
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

Some time after that, the United States passed a law that the Federal government could not discriminate on basis of age, over the age of majority. Thus, the "under 45 years of age" disappears.

Some time after that, the United States passed a law that the Federal government could not discriminate based on gender. Therefor, the "males" disappears.

That leaves us with "able-bodied" " at least 17 years of age" and "who are, or who have made a declaration to become, citizens of the United States..."

If you are able-bodied, over 16 years old and a citizen or have declared, you ARE the militia. Whether you join a group to become "A well regulated Militia" is up to you.

They did NOT "challenge the government" That was the action of the protesters, just as we did at Bundy's Ranch. All the Hammonds did was set a protective backfire, just as the federal agents do in such cases. It burned a few acres of federal land before they got that end of the fire under control. Just as the backfires set by the federal agents will often burn private property.

John Roberts gave us the tool to defeat Obamacare in court. He said the "fine" was actually a tax. That tax originated in the SENATE and the Constitution says all taxes must originate in the HOUSE. We had the hammer but nobody was willing to use it.
