Courts are designed to handle actual controversies, not hypothetical ones. For example, a legislator or citizen cannot file a lawsuit to challenge a law that has not yet been passed by the legislature. They cannot ask the court, "hey, we're thinking of passing a law that would do X. Determine if it would be constitutional." Only after the law is passed can it be challenged.
