Only me and someone on Democratic Underground who sourced my material have cited Greenwald's decision to secretly record a trial witness.&lt;/p&gt;&lt;p&gt;Greenwald's Frequently Told Lies attacks a straw man.  It focuses on the fact that he wasn't disbarred or "sanctioned or disciplined by any court."  I never made the former claim and the latter relies (in a rather lawyerly manner) on an overfine distinction.  Greenwald's conduct was found "unethical" and he was told to stop.&lt;/p&gt;&lt;p&gt;Greenwald also points to a later document that acknowledges the possibility that he might have reasonably believed his conduct was legal and which refused to comment on his character.  Greenwald hopes you'll mistake that as exoneration.  It's not.  It's merely the court being agnostic as to his intentions and saying it won't judge his character.&lt;/p&gt;&lt;p&gt;My point is (and has only ever been) that someone who preens and struts as a libertarian defender of privacy shouldn't secretly record people to use their words against them.
