Also, at the state trial, when the most vulnerable of the employees were called upon to defend the authority's characterizations of the working conditions, the best they could come up with was one of them getting their sleeve caught in a machine once (which ripped the sleeve), exposure to ground spices, dangerous refrigerating chemicals going through the pipes in the walls, and the like.

"Poor old Rubashkin,' as you put it, was the victim of vicious smears by interested parties as a way to further their own interests and agendas with no real facts to back them up. That is why the public was mostly silent at the time - he had been so demonized that people were willing to 'let him rot.'

The shocking prosecutorial and judicial actions woke people up, and the more the facts are examined, the more this is recognized for what it is - a shockingly unjust sentence, based on an unfair trial in front of a disqualified judge.

That link is to parts of the federal affidavit filed in pursuit of a search warrant. The affidavit has been shown to be... 'unreliable,' to put it delicately.

Just for the benefit of the 'parachute analysts' who drop in and analyze based on a Google search, then based on their 'findings' condemn a man to life in prison where thousands of experts in their fields who have studied the details of the case scream injustice, I will summarize some of those points that pertain to your link:

Firstly, despite the juicy headline, the number of allegations in that list that relate to modern slavery, or any other kind, is ZERO.

The bulk of those claims relate to the presence of false documentation of illegal aliens, a national epidemic and something which that document itself, and sworn testimony since, acknowledges the company did their duty in screening - successfully, in the case detailed in that document.

The incidences describing a supervisor abusing his authority have since been established as just that - an isolated instance of individual abuse of power.

The incident regarding the "hasidic floor supervisor" is patently false, as there were never any Jewish floor supervisors - easily identified by their distinctive safety equipment. (This is one example of many fabrications, including detailed description of work conditions at a non-existent plant, allegedly identified on a map)

Finally, and most tellingly, the allegations of meth production - juicy though they are - were not considered credible even by the Feds, and certainly not as an ongoing concern. Eyewitnesses asserted, and recently released FOIA documents confirm, that no Hazmat team was brought for the raid, SOP when meth production is suspected.

Recent history (the Trayvon Martin case, in particular) has shown us that inditements are not quite the disinterested, authoratative and factual documents you might assume they are, or believe they should be.

Judicial bias is reason to overturn a case because the judge has exclusive authority over what is and is not admitted as evidence and makes countless other decisions that shape the results. Many legitimate arguments were excluded in this case, and any fair-minded person would abstain from judging guilt or innocence based on evidence filtered through a disqualified judge.

As an American citizen, he has a right to a fair trial. He has been denied this right and unjustly incarcerated for close to 1000 days. G-d willing, the Supreme Court will overturn this travesty.

I read the blog post you felt was criticizing your reporting. It is actually criticizing a different reporter who misrepresentedd your piece as a report on the "routine sexual harassment that female employees at the Agriprocessors plant faced," a statement of fact instead of the as-yet unsubstantiated allegations, serious though they may be, which is how you reported it. The paragraph you quoted actually reads "If you read that report," a reference to your original article.

I should note that I think this article is a balanced article, just that I wish I would have been contacted, since the AP article itself was far less than accurate.

Lynda, you should have called me before writing this story. I contacted AP about the factual inaccuracies, omissions and misrepresentations and they are reviewing the matter. If you would have called me, I would have advised that you hold off on writing based on that article while it is under review.

Incidentally, the UFCW blog does not mention the fact that they have a financial interest in Agriprocessors and bringing pressures to bear on the company, a fact which is generally ignored by the press (although you mention it here) even as they make sure to list all the charges against the company whenever they can, even when it has no direct bearing on the subject of their writing.

This is unbelievable. This article is full of misrepresentations, starting from the headline, and includes a quote from me which is taken from comments on a blog, is totally out of context and misrepresented, and I will be contacting the reporter of this and her editor. I was not contacted for this story, I would not comment, since I am not a representative of the company and was asked not to comment. One more example of the outrageous treatment of this whole episode by the media.
