Several more cases of the blatant abuse of the elderly as APS, and other agencies fill their quota's. Our elderly are now targeted and used as cash cows as federal, state and local funding, subsidies and grants are distributed based on these ever expanding quotas. Now......throw in the property that is stolen, including homes, investments, savings, SS checks, VA checks, personal items of value, anything and everything that was the result of a life's work is now owned by the professional predator. The victim is now nothing more than chattel property, owned totally by the predator. What a system! Washington knows, your local government and state governments know, the upper courts know......and yet not one of them will lift their hand to stop any of this. Check out the CRIS system.......this is where and how judges receive anonymous donations to their "retirement" funds. This can include stocks, bonds, and cash and real property. In any other situation, this would be considered money laundering resulting from bribery.

The majority of elderly residents have been intentionally isolated from their families by the predators acting as guardians. and that is just what these individuals are...predators. The professional guardians in tandem with courts, agencies and other "interested parties" make sure the victim has no contact with family, friends, churches or other social contacts. They do this to convince the victim that no one cares about them. This makes them very vulnerable to abuse in these warehouses they call nursing homes.

A family member or other advocate who insists on actually seeing the victim is faced with the threat of criminal trespass if they do not leave the property. The police are more than compliant in these situations and will act on behalf of the home rather than the victim.

The larger the estate, the more likely the isolation while the estate is pilfered. After all...we can't have any witnesses to the theft that is about to take place.

I agree! Collecting skewed statistics in order to skew the results is not a relevant study at all. This is a carefully planned and implemented system that obsessively avoids the real predators in the system. Those are the professional predators that work through and with the courts to loot estates.

The judges are "selected" now. Here they are put on the ballot as the only choice..no competitors. Even if you don't vote for them, they already have the job. They do not campaign, nothing is made public about how they handled the bench or what they did or did not do. The BAR and all its union members (and it is the largest most lucrative, powerful union in the country) monopolize our courts and have destroyed any sense of the law. Corruption is an understatement.

We have been exposing this issue for nearly five years. While legislators did little to nothing to stop this legalized theft and the imprisoning of seniors in participating facilities, families were destroyed and many of the targeted seniors died horrific deaths either abused and neglected in the nursing home, or drugged to death, if not both. Probate courts are Article III legislative courts. The legislators in each state could fix this immediately if they would, but are up against the BAR Assoc which has a vested interest in keeping the system running as is. And while Nero fiddles in the legislatures, our elderly are still being abused and neglected, still being dispossessed of all their life's assets and still being held prisoner against their will in these horrible places we call nursing homes.

The judges are paid by the taxpayers and also take 2-5% of the value of the estate in Florida. They also make money everytime one of their good buddy attorney's files a motion into their tribunal, which is what probate courts are. They are legislative tribunals, not subject to common law, but rather, a special set of statutes erected just for them to use! Also, that courthouse may not actually belong to the state or community. We are finding that many are privately owned by the judges, and/or the BAR and are leased back to the city, county, state for use. When a judge says to you that it is his courtroom, and the law is what he says it is while in it......he's probably telling you the truth.

What no one mentions is that pension funds belong to the pension fund owners and NOT to the employees invested in them. Until the fund actually puts the money in your hand.......you own nothing except a worthless piece of paper.
In the interim between the time the investments are made and you come to claim your pension, the Pension owners may, spend, squander, misuse, badly invest, and otherwise mismanage what you thought was your fund. They are not held responsible because the courts will tell you......the fund belonged to them and you were simply a powerless investor stakeholder with no viable claim.
Then they do what they are trying to do with the SS fund they owe 3.2 trillion to in "borrowed" surpluses........they go back to the taxpayer and demand that they anti-up to cover their bad business deals that blew your retirement.
Read your investment/pension fund CONTRACT carefully......in there somewhere it will state that you can make no claims against the fund owners, and you are owed nothing as this is a risk manager and you risked it all!
When Walker (WI) was railing about how pension funds were breaking the financial back of the state, he never once alluded to the millions upon millions that had been invested on behalf of employees that had been blown by the fund owners and that this was the problem.........not the pension plan itself.

This article, like the one about Minnesota attorneys who were going to "investigate" elder abuse in that state fails to acknowledge the real threat to seniors from professional, profit motivated attorneys, guardians and others, who see the elderly as prey. While family and friends do commit a fair number of these crimes, the most vicious crimes are committed in the probate courts where "friends" of the court are handed the ownership of another human being who is now reduced to being a "ward". The estimated 5-7 billion a year pilfered from the elderly under the guardianship system ends up in the bank accounts of those who make their living as professional parasites. Until the actual issue, the actual threat to the elderly is addressed honestly, don't expect me to stand up and cheer for another BAR Assoc, guardian assoc, panel of self interested experts who have no real interest other than keeping and maintaining the status quo.

I agree Elaine! Who is appointed as conservator will most likely be decided by how much financial worth the person conserved has. If there is a potential for profit at the expense of the person conserved, you can bet the family will be jettisoned out the court room door to make room for all the professional predators that make their living preying on the disabled and the elderly.

The writer appears to have forgotten that all law enforcement EXCEPT for the elected office of sheriff, was put under HSD during the Bush/Cheney crime era. Biden's son attacked the office of sheriff in his state, leaving that person(s) unable to act as any other law enforcement agency. This was done approximately the same time as the Coast Guard was brought under the Navy and converted from civil service to a military organization. The Coast Guard is the federal police.....now able to ticket on land or water. At their discretion, you can be taken to an administrative tribunal or military tribunal. Either way, you have no rights.

We have been battling this system of racketeering for several years. The entire system was set up intentionally to allow for the wholesale theft of estates under the protection of a probate tribunal. These are NOT courts of law. IF in fact a person does need a guardian, being deemed a "ward of the state" should not mean being stripped of all your rights and liberties. If a person is actually so vulnerable that they need a protector, would their rights not also need to be reinforced to secure their safety and equal protection under the law?

Causing the civil death via probate, of a living human being needs to be called what it is. Modern day slavery......and the new slave owner now possesses the everything the new age slave acquired over a lifetime. Taking their possessions is bad enough, but when you deprive them of their life, their families, their religion and most especially their freedom, you have created a new class of slaves.

This is human trafficking for profit. We just haven't gotten to the point where we openly auction them off to the highest bidder.

It is not safe in America for the elderly.

The cat is out of the bag on vaccines. This isnt to prevent any disease, it is meant to create it, reduce IQ, and then track the efficacy of the viruses you are infected with. I would be surprised if Kennedy isn't taken out...permanently. This is what we do to traitors to the corporations and profits.....they just mysteriously cease to exist under strange circumstances.

And if this commenting was accurate, it would include the provision in nearly every state's statute that any legal instruments including Durable power of Attorney, wills, estate plalns, advance directives etc., can be discarded at the tribunal administrators discretion. Check Florida statutes definitions 422. for more on this. Those legal instruments and estate planning are thrown out routinely by these administrators and all of those powers handed over to for-profit guardians who are now presenting themselves as the victim (legalized identity theft) and begin bleeding the estate.

According to Florida statutes in the section under definitions: A "judge" may discard any pre standing legal instruments he/she sees them as an obstacle.....
The obstacle being access to the estate.

There are steps people can take to avoid this.....unfortunately, those steps have been thoroughly rendered void by intentionally constructed statutes which make the paper they are written on worthless.

Guardians in Florida are considered among the most prolific predators in the country. the human trafficking of the elderly through the probate system in Florida is a study in greed, sociopathy, and an absolute disregard for the victims.

And not one of these "guardians" are asked for nor do they supply any evidence to support their contention of incapacity. When medical opinions are available that counter their claims of incapacity, "court friendly doctors, psychiatrists and others produce opinions, many times without ever seeing the victim" and the victims family, private doctors and independent examiners are excluded from making any statements. The administrator will make sure they are never allowed to speak;

And the audits you speak are seldom produced or even asked for. Regardless, no matter how outrageous the billing, including charges by the hour for visiting with their own children, the "court" never sees a problem. Go figure.

Nice soft soaping of the issue, but the above comment is clearly meant to paint a pretty picture in a system that is insidious. Ugly is ugly....no matter how yo udress it up.

Emergency hearings can be granted in your state courts, with an actual judge of the law who is required to follow rules of evidence and to allow all evidence to be presented on either side of the conservator issue. BUT! This is exactly why this will never happen....if you allowed all actual evidence in to counter the claims of need for conservator......few petitions would be granted. Thats why these kangaroo tribunals were set up with their non-constitutional statutes.....to facilitate the trafficking of human beings while robbing them blind.

When that need arises......then you should be in a civil court in front of a judge of law with a jury present who can hear the evidence and see for themselves whether the emergency guardianship is warranted. No one should be declared civilly dead in the law and be stripped of all their natural rights and liberties without having an opportunity to defend themselves, by being declared a "ward of the State". This term is the defacto death certificate of the living human being. Your name in all caps denotes a "dead mans estate". It is a legal symbol saying that you no longer exist....but your assets do! Years ago, the usage of terms for attorneys was "personage"...the theft of another persons identity and property, today, we call it guardianship. Ward of the state is just another form of human trafficking that some.people can get away with ...although you couldn't.

WRONG! that vast majority of private for profit guardianships that are abusive are dismissed and not recorded. Not reporting the crime is not the same as having NOT committed a crime.

When statics are compiled that are clearly skewed to sway public opinion so that the racket that is running can keep running, I have a problem with that. when you only collect statistics conducive to what you what people to think and believe and refuse or neglect to report honestly the thousands of cases of for profit abuses....you have failed to prove your case.

Few states have taken any steps to improve or increase oversight. And Florida was one of the first states to legislate closing the access off to courts of law trapping the victim and families in this arbitrary system.

This is about human trafficking ... a carefully constructed system used to methodically rob the estate at the expense of the targeted individual. People DO have their affairs in order but under the statutes, carefully written to allow these ministerial clerks who masquerade as "judges" to discard those estate plans at will, to cast them aside, these plans mean nothing. This is not and never was about protecting anyone, most especially the elderly. They are simply seen as a revenue stream for the predators. Guardianship was never meant to be what it is today. And, if you are going to take someone's identity, deprive them of their family, isolate them in some house of horror you call a nursing home, and then avail yourself of their property., shoudln't this take place in a court of law with a jury present to hear the evidence of why this theft should be allowed?

California's recent announcement that they were considering conserving all the homeless is just the newest version of how to use human beings as an ATM. The "conservators will simply make sure each and every one of them is either already on SSI or SS, or will get them signed up for it......then the conservator will make themselves the assignee on the benefits and laugh all the way to the bank. they are also hunting those who have VA or railroad retirement benefits....they will take them too.....all to benefit the ward who will still be homeless in the street or stashed in some hole of a nursing home or other warehousing institution and left to deteriorate.
