In the 13 volume of the manga it shows that Light WAS actually supposed to smarter than L.

Kira has a perfect view of Justice and how the world should be. A lot-most criminals are released from jail have not learned not to commit crimes they've just learned how not to get caught and some of them just get pushed out because they don't have room in the jail.
Criminals need to be prosecuted to make an ideal world. A lot of criminals ,usually the more dangerous ones, do not learn and don't care that what there's doing is hurting others. There IS a death sentence but only for really advanced crimes, some people don't give a care if they just go to jail, death is much more convincing.
