Since day one (back in 1776) it's always been about government control of citizens and commerce. We got rid of a monarchy but replaced it with a corrupt Marxist federal government in 2008. The War Between the States revealed that the states had few rights (the US Constitution notwithstanding) and the federal government would be the arbiter of all our liberties, granting them as it (not us) saw fit. Until Americans understand that John Locke and Adam Smith (yeah, old, dead white guys) were absolutely right, Americans will labor under the thumb of a hegemonic federal government.

The mandatory ELD rule won't be published anytime prior to the midterm elections in November. The Obama regime doesn't want to ruffle feathers until after that election (Obama's administration is run completely with election cycles in mind, not what may be efficacious or necessary).

You'd think that because the federal government dictates the number of hours we can drive and how long our off duty time must be before driving again, they'd snap to the fact that big trucks need SOMEWHERE to shut down for the mandatory rest period. Well, that just kind of slipped their mind. Typical of Big Government, they make laws and rules that sound nice to the low information/non-critical thinker, but in real life, those laws and regulations cause more problems than they solve. And who does the public put in office? An inept, ideologically-driven socialist who wants everyone's life to be run by the government.

Yes, but those carriers also come under the PHMSA as well as Part 387. Generally, as indicated in Sec. 387.3 FMCSR, Applicability, (a) applies to "for-hire motor carriers" operating interstate and then in (b) any carrier transporting haz-mat, haz-waste, etc in intra- or interstate commerce.

The FMCSA regs (Part 387) covers minimum levels of financial responsibility (lawyer-speak for "insurance"), but it is only applicable to "for-hire carriers" (apparently not for the private motor carriers). State insurance laws would indicate minimum insurance requirements for those private carriers. The insurance requirements will only be published AFTER the mid-term elections, of course, because the Obama regime doesn't want to piss off any voters (yet).

Yes, that's correct, but I was told that I couldn't shut it down for a break unless I ran a full 10 hours, so if I was finished delivering (drop & hook) at a store, and still had an hour to run, I had to leave the store and head for another store/warehouse. I had to shut down enroute for another break; the point was that they pushed us to use ALL legal hours and didn't dispatch us based on pickup or delivery times, just on how many hours we had left on the 10 hour rule.

I was detailed by JB Hunt Transport to pull Wal-Mart trailers out of Marcy NY and shuttle them around (about 13 years ago). The Wal-Mart dispatchers demanded we run a full 10 hours, then take a break. As everyone knows, there is very little legal truck parking available around the NY/NJ/Eastern PA area, but Wal-Mart didn't really care about that. On the plus side, they did NOT require us to violate the HOS regulations or even to coerce us (as some companies do).

Too bad they don't see the "30-minute rule" for what it is: a way to get the driver to violate the HOS regulation. It serves no other purpose and slows down commerce. It doesn't give a driver any rest; he just has to pull off the road, park, and sit there for 30 minutes. Big whoop. If he doesn't, he gets an HOS violation.

You seem to know a lot about this, so do you have first-hand knowledge of "human trafficking"? If so, why didn't you report it? Seems you want others to get all riled up and force the federal government to give you grant money to "study the problem and raise awareness". Or maybe you already have the grant . . .

On 12/off 12. Way too logical for the federal government to implement, though. The 70 hours/8 day rule means the dispatcher can legally work (driving + on duty/not driving) a driver 8.75 hours per day, 7 days/week. Even if the driver exceeds the 70 hours before the end of the 8 days, the driver is still expected to work (on duty/not driving). All without overtime pay. Yes, the system needs fixed but you'll never get it fixed without rescinding the old system and devising a new one.

Quite true. Business procedures tend to be cold-blooded but for a good reason: the imposed fiduciary duty that requires the officers of the company to run the business responsibly and create value for shareholders. The government, on the other hand, has no obligation to insure the trucking industry is run responsibly. Sure, the law says the government must regulate safe operation of commercial vehicles, but what if it doesn't? No one will be fired from the government. The blame is cast down upon the industry, the private companies and the drivers.

The premise that ELDs prevent crashes is illogical. Observation of something changes behavior. It's why judges/lawyers don't want cameras in the courtroom. I say, mandate that every vehicle (including government vehicles) have driver cams and black boxes in them. Allow cops to pull 4-wheelers into weigh stations and get a Level 1 inspection. Make it a felony to tamper with the equipment or block the cam. An armed society is a polite society and an observed society obeys the laws. (Of course, none of that will happen. The public wants everyone else to be observed, just not themselves)

And the point is that society needs truckers? Yes, but society needs garbage men, teachers, doctors, salesmen, construction workers, etc., too. So shut down for 3 - 4 weeks and disrupt the entire country and prove what? Something everyone with an ounce of critical thought already knows?
