"Fair and reasonable" would have been for the airline to keep on upping the reward - which contrary to the author's claim is not set by an absolute ceiling - until a few passengers could no longer resist.

"Legal" would have been for the airline to tell four people at the gate that they were being bumped, i.e. before they had already been boarded, and then compensating them pursuant to 14 CFR 250.5.

If an airline's right to "deny boarding" extends to someone who has already gotten on board and is sitting in his assigned seat, then yeah sure you're totally right. Maybe one of United's lawyers will try arguing that before settling.

The way I read the regs, the "maximum" compensation is in relation to the 400% that the airline is required to pay. That is, the airline MUST pay 400%, but only up to $1350. Someone correct me if I'm wrong, but the airline CAN pay compensation on top of that...

Also, I agree with other commenters that "denied boarding" is hard to argue when the passenger is already in his seat.

He told Podesta the hearing was that day - something Podesta would have already known if he was paying attention to the Judiciary Committee, as hearings are noticed a week in advance including on the website. That's why I provided a link.
